In a move that surprised very few, a B.C. Supreme Court justice has granted TELUS a temporary injunction against a series of ads from rival carrier Rogers. As you might recall, it was on November 12th that TELUS filed suit against the Toronto-based company feeling that its ads touting “Canada’s most reliable network” with speeds “two times faster than any other” were “false, misleading, and harmful” to its business. Rogers admitted in court that it no holder holds the top spot when it comes to network speed thanks to TELUS’ newly-launched 21Mbps HSPA network, but it did argue and lost on the reliability front. Rogers has filed an appeal and vowed that “further steps will be taken shortly,” but has been ordered to return to court this Friday to discuss the pulling of the ads.       Telus and Rogers actually love each other.

      They are only doing this for show only and trying to restrict WIND mobile by steering up the perception of competition so WIND mobile supporters can’t argue.

    yes, Canada is filled with activist judges, in the US is a bit different, and they have a more strict interpretation of the concept “misleading advertising” that’s why you see at least a different outcome in the ‘red/blue’ fight

    Well good to see somewhere accountability and credibility mean something. I live State side so no thoughts on these carriers. Now I’d like to see how things continue with Verizon & AT&T… and now also Verizon vs Sprint for there “most dependable” network claims.

    Friends, Canada sucks. I know I sound like Barney Stinson when I say it, but really I’m Robin Scherbatsky with a penis and less hot.

    Our country expects zero innovation and zero productivity but raises a fuss when “foreigners” try to step into our territory. We’re a bunch of preschoolers content with playing in the sandbox while those foreign 6th-graders want to build a theme park using the entire backyard.

    we went wrong somwhere when we alienated the world only to protect canadian business and content. i really don’t understand this suit tho, those ads are well over 2 years old, and now telus with their almost 3 week old service is wanting top spot? in the real world i think telus has now realised that after taking a look at their grossly inflated plans no one is wanting to switch. bell sits silent cause people are going to them over telus. i’m waiting for telus to sue bell next, not sure for what, but i’m sure they’ll come up with something

      Why would Telus sue Bell when they are the same network – aint no big 3 anymore, it is a big 2. Hence why Bell was sitting on the sidelines saying they were the most reliable network while Telus only sued Rogers for those claims.

      It’s actually rogers that has inflated prices.

      For the same thing that TELUS offers for $40.
      Mobile internet, a special call option and 300 minutes.

      Rogers takes and prices it at $50, gives less internet usage, though keeps the special call option and trumps it down to 200 minutes.

      Way to fail Rogers.

      I bet you people that had 3G problems all throughout the last two months are going to turn away now. I know I’m asking for my money back for those two months.

        The only experience I have with the new Telus 3G network is through the experiences of two friends who got bought into the Telus programs over a week ago. Seems neither has their iPhones working after many service calls and broken promises. Problems switch around but are generally a lack of working 3G data; no visual voice mail; no voice service; no SMS. Telus has not provided any fixes that stick. One of the friends has given up on the service and gone back to the old phone on the old network. He has to get work done!

        Meanwhile, I have had an iPhone on the Rogers network for over 2 years with no problems at all. Roaming works; tethering works; SMS/MMS works; voice mail works; voice service is better than my my old phone ad on the Telus network; etc… My wife is also problem free with her iPhone on the same Rogers network.

        It is nice to have alternatives to Rogers for iPhone service in Canada . It would be better if the alternatives worked!

      I can’t even get 3G signal the whole way from Toronto to Ottawa. I can’t wait until Wind launches so I can cancel my cell phone plan with Rogers. I’ll finally be free of Rogers. This coming from someone who had Internet, TV and 3 Cell Phones with Rogers. You guys need to find a completely different way of doing business.

      How is it valid when I was at Bathurst and Bloor, saw the 3G symbol on my BOLD 9000, and couldn’t connect to the internet, or send any facebook messages?

      How is it valid when my phone calls go from 3G -> EDGE -> GPRS and then get cut off?

      I’ve got important calls I’ve got to make, and I can’t have them disconnecting.

      If this issue keeps up, Rogers will be labeled as the worst service provider by many multimillion dollar corporate clients. You do the recent Ted Rogers Sr. pretty badly. He’s turning in his grave.

      Yeah, with the two of them sharing their HSPA+ network, they won’t sue each other over that. Telus will probably chime in a bit about having the fastest network too, but right now Bell is taking a lot of the spotlight simply because they are the official network of the Vancouver 2010 Olympic games (less than 100 days away?) and they are carrying the official phone of the Vancouver 2010 Olympic games (Samsung Omnia II). Why Telus didn’t get this honour… is a very good question.

    I was on Rogers for several years and recently had a Bold 9000 with the latest OS. I had no real complaints. Signal was good, few dropped calls and decent battery life.

    Compared to AT&T or Orange/O2/Vodafone in the UK Rogers rocks.

    I just got a Bell 9700 way faster than Rogers, reliability seems about the same.

    I am in the UK at the moment and O2/Orange still are terrible. Especialy for battery life. Barely get 10-12 hours with all the switching about.

    This compares to 3 days in Canada with 3G, BT and WiFi.

    Rogers has never had the more reliable network and now that Telus and Bell have upgraded theirs, Rogers doesn’t have the fastest either. Sounds like a good enough reason to have those ads pulled.
