Judge denies Apple’s request for expedited patent trial with Samsung

A federal judge on Tuesday denied Apple’s request for an expedited trial in the company’s patent case against Samsung, FOSS Patents reports. “The Court agrees [with Samsung] that Apple has not established substantial harm or prejudice justifying a shortened briefing and hearing schedule for its Motion to Expedite,” Judge Lucy Koh of the U.S. District Court for the Northern District of California said. Judge Koh also pointed out that Apple “had been aware of its infringement claims for at least a year and engaged in negotiations with Samsung during that time,” so the company has had more than enough time to consider possible legal courses of action. Apple recently filed requests with both a U.S. district court and with the International Trade Commission seeking a preliminary injunction to block the import and sale of several of Samsung’s mobile devices. Apple calls the devices, which include Samsung’s Galaxy Tab 10.1 and the DROID Charge, “copycat” products that infringe on Apple patents and mimic Apple designs.

        There is a huge difference between copying an idea and deriving ideas form an idea. The devices in question may look similar to the iphone but have different components and different physical proportions (it is difficult to change that much form a black slab) – its comparable to GM trying to sue Chevy for infringement for using 4 wheel cars!

        I think it’s kind of a stretch to say they made a new tablet. They just made the same tablet thinner after Apple revealed the size of the iPad 2. 

        It never occurred to you that someone could do that? Isn’t that natural competition between companies in the same space? You look at your competitors and try to correct the things they do wrong or don’t get?

    I own the Droid Charge already, so I’m not worried about that being sold or not, but I DO have a Tab 10.1 4G on order from Verizon. Is it possible this situation could delay that order indefinitely?

      Part of the lawsuit is that Samsung’s TouchWiz interface is a copycat of Apple’s iOS interface. Since the Droid Charge runs TouchWiz, it’s included in the lawsuit.

    one day apple will sue every human on earth for having dna that they apple hold patents on. Air is probably next on the things Apple is trying to patent. Why can’t apple just compete and let the end user decide what they want? No one will confuse a Samsung for an apple. If ppl are buying Samsung it’s b/c they wanted Samsung. While touchwhiz may look like ios it has it’s own enhancements which make it different. Apple needs to lose every one of these lawsuits just to make them sit down and compete.
