AT&T: No class action lawsuits for you

News

While we sincerely hope this most recent change to AT&T’s ToC wouldn’t hold up in any court of law, AT&T’s latest addition to its terms and conditions is yet another example of the terrible joke that US carriers are becoming. Last week we covered the new paper billing fee T-Mobile has confirmed it will be implementing soon and now we have this — a newly discovered clause that prevents AT&T Mobility customer from entering into a class action lawsuit against the company. Beyond that, the section this snippet was pulled from is intended to limit dispute escalation to binding arbitration or small claims court as opposed to “courts of general jurisdiction”. Seriously.

Any arbitration under this Agreement will take place on an individual basis; class arbitrations and class actions are not permitted.

Now if you’ll excuse us, we’re going to go chat with our lawyers to discuss the possibility of filing a class action suit against AT&T for trying to stop us from being able to file class action suits. Not really, but we should.

    Seriously…just saying you don’t have to sign the contract doesn’t mean that this is ok. This shouldn’t be an option by any carrier. This is why people are hating the phone company because people are starting to feel like they can do whatever they want to us with nothing ever being said. They can put this in their contract if they want to, but all it does is make me not want to jump back on the AT&T wagon again. I hope it encourages (along with their obnoxiously high prices) people to move on to different carriers also. Although many of you won’t because you are on your iphones! I hope they have App for this!

    I believe that Washington State has a law that supersedes this craziness by AT&T and allows you to file a class action lawsuit.

    Give us some comparison of contracts and most important pricing. For my ATT contract with 6 lines ATT still gives me the best rate overall for just phone-no data.

    No apples here.

    Um that clause has been in contracts going back to at least 2003 when I was a sales agent for Cingular, this is “news” because someone finally read what they sign.

    Verizon Wireless has the same terms…. Once you sign a contract you can’t sue VzW you must enter arbitration….

    Why is it allows for VzW but not AT&T?

    Well, it would certainly seem that this is a change of contract, so anyone not happy with the changes can cancel their service and not pay cancellation fees. I don’t think it’s cool that at&t is doing it, but you now have an option for an easy way out of their services… then once you’re out, sue this piss out of them.

    I’m not a lawyer, but AFAIK a company saying you must agree to its terms doesn’t necessarily make it so. For example, a parking lot operator might post signs saying they’re not responsible for any damage whatsoever to your vehicle, but under some circumstances they may in fact be liable. Also, a company certainly can’t force their customers to comply with terms that are illegal.

    Apple’s biggest single problem in the iPhone space is AT&T, but without AT&T or some other mostly-cooperative carrier, there wouldn’t _be_ an iPhone market.

    Yes the arbitration clause has been on phone contracts FOREVER. Not being able to file a class-action suit has not been on any contract I’ve read. I love people who are like “verizon has the arbitration clause BFD. Dont sign the contract. Dont get a phone blah blah blah” you guys are missing the point, we can’t have class-action suits any more. And yes boo hoo “we only get like $.02 from a class action and the lawyers get all the money.” We do however keep the company’s in line with class action suits and while the costs may be passed to us, they can only pass so much before we stop buying and they have to clean up their act.

    I doubt this amendment can stop anybody from being involved in class action, we’ll see though

    We need to have someone see if they can walk away w/out a fee due to this. Its always nice to get to start fresh and plan shop. Who cares about having to change numbers… Just one mass text msg away!

    Just got confirmation today, my friend works at at&t and yes, you can cancel your contract with no cancellation fees as soon as you get a letter from at&t in the mail about the change in contract.

    This just goes to show that they know their service is crap… Off topic here… Question – If the iPhone had the Moto logo on it and was identical in all other ways, would it still be as popular? Hmmm…

    IM INTERESTED IN A CLASS ACTION! ATNT HAS BEEN OFFERING FREE PHONES TO THE EKDERLY THEN CHARGING THEM $70.00. also STILL ALLOWING THIRD PARTIES TO BILL FOR SERVICES NOT RENDERED, ie ring tones and computer services

    If someone starts the lawsuit, i will sign it. Their fees are too much. I had a cellphone bill of $700 for 2 months, had tried for months to figure out what was going on, changing service every month & the only thing that has stopped them charging me so much is i just don’t use my phone. They don’t give you but a couple of options anyway – what about 3 different plans? They have gotten too big for their britches.

    I have had it with ATT in NYC and any other City. I can’t believe it, i’ve been struggling with ATTs horrendous service for 3 years.

    I own a small business in NYC and my entire staff is on ATT. I’ve tried everything to make the calls more reliable including buying everyone the latest phones (BOLD, iPhone, etc…) hoping that the “better” technology would somehow cure the lack of service.

    Each time i spend $400+ on a new phone for myself or an employee, it seems that the service gets worse. It’s gotten to the point that i have TWO phones for myself. One is VERIZON (AMAZING) and the other is my ATT Bold which i use for Blackberry Messenger only and TXT between myself and my guys. I still Keep ATT because i frequent europe and i acutally like their 59.99 data plans for international. That’s the only good thing about ATT. And would you believe it, while traveling overseas, in some 3rd world country, my ATT phone roaming on another network peforms AMAZINGLY!!! It’s just the ATT network. It’s over used, under funded and just HORRIBLE!!!

    I’m now fed up wth the massive overages because we have to connect 4 or 5 times to get a 2 minute phone call across. I want to bring my whole company to Verizon or Sprint but i don’t want to get hit with the massive cancellation fees from ATT that the switch will bring. What to do??

    Listen, i have very powerful attorney’s at my disposal and i WOULD LOVE to initiate a class-action lawsuite on this company. Their advertising is TOTALLY misguiding (most bars, yeah right!!!) and their 3G service is non-existant on any 3G device (in fact, the only why my Blackberry even works at ALL in NYC and surrounding areas is if i manually turn off 3G, a feature just added to the BB OS).

    Anyhow, back on track, if anyone wants to initiate a class-action suit, please email me at thechris1013@aim.com. I’m fed up and i’m gonna do something about this.

    I’m taking ATT to small claims court .. they don’t know what they’re doing from one month to the next on billing .. they sent me a audit pack stating I was @$0/bal. due to all the adjustments they did due to their screw ups .. they I get bills that have now accrued to $2700.00 approx. — !!!!! Months/days/hours on the phone w/the runaround .. done with it .. onto Verizon .. I would help anyone with a lawsuit in providing my info .. I have doc’s to prove just how nuts they are ***

      Join the club of unhappy ATT customers, they have a monopoly on their phone lines and there is no way to get away from them completely.
      Congress should stop them
      I seldom get two bills in a row that is the same because of their screw ups, I am constantly being overbilled

    Hey u guys i am going to make this short they got me in the late 80′s early 90′s and damn if they did not do it again. Check the history of ATT and u will find out what i am saying is true.. I am down here in Georgia but i was born in Bedstuy whoever has a good lawyer can u recommend me… I got my bill and my wachovia payment in hand the that bullcrap arbitration message they sent me in the mail.. I new it was messey when i read the first line.. 175.00 my u know what lets try for more the same way they did us…
