Apple wins in Australia: Judge bans sale of Samsung Galaxy Tab 10.1

Apple won a patent infringement lawsuit it brought against Samsung in Australia, The Sydney Morning Herald reported on Thursday. The ruling prevents Samsung’s Australia-based businesses from selling the Galaxy Tab 10.1 locally. Samsung had originally agreed not to sell or advertise its tablet in Australia until the court issued its ruling on the matter. In late September, the South Korea-based phone maker proposed a secret deal with Apple, in which it would tweak the parts of the tablet in order to avoid infringing on the iPhone maker’s patents, but Apple subsequently shot down the deal. Similar lawsuits are ongoing around the globe, including in Japan, France, the Netherlands and the United States.

        So far two separate court systems have found that the galaxy tab is such a blatant imitation that they have completely banned it’s sale country wide, yet you still boo apple. Tell me, why would a company choose to loose money to an imposter, when it has now been twice proven that it is in their legal to stop its production? If Samsung was really “fueling innovation”, then these lawsuits wouldnt matter.

        The German court who issued the ban was based 100% on the way the device looks. As if only Apple has the right to make a device that is a square/rectangle that is black. Watch out LG and Sony, your TV’s look like supersized iPad’s, which are just supersized iPod Touches.

        This second ban from what I have read is based on a patent that apple holds on how you navigate pictures from a gallery. Which is the most ridiculous patent I have ever heard of in my life.

        If Apple wasn’t scared that Samsung was going to steal their business then they wouldn’t need to sue right? I mean since we are basing this off of your logic. Why are they suing them if they aren’t worried?

        a truly competitive company would just man up and make a better product. Apple somehow gets away with shitty incremental updates every other iCLone release… Android users have a higher standard it seems, as there is always something new and better coming around the corner.

        Well sense I don’t have direct Knowledge of the case, I would have No Idea!!! If there’s no case, it ends up getting tossed, if there’s a case the other way and Samsung ends up suing Apple, that’s fine by me also. It’s really nothing to worry about. Get upset about. It’s part of doing business these days. Apple has to pay Amazon for using the 1-Click Purchase for example. That to me seems really silly. That’s how it is. We now have yet another new Android company just today going to be paying MS to use Android. It’s a growing list. I really don’t care who wins this latest case. I don’t know all the so called FACTS in this case. What some Blog might say means nothing.

      Last I checked Apple was using child labor to build their iProducts. I’m sure Samsung has some stuff made in these places as well, but no corporation is “good.”

    The fact that Samsung was even willing to make changes and apple still told them “too bad, go sit on a stick” says apple is just court blocking the competition to stifle, not because of their patents.

        This is something you may want to consider before bragging. The original record that this one “beat” was 600k iPhone preorders. This was when the phone was exclusive to AT&T, now that we have it on multiple carriers lets do a little math. Lets say that every carrier has an even amount of preorders.

        1,000,000/3= 333K~ per carrier.

        That isn’t as good as AT&T’s 600K or even close. You Apple fanboys must have a rolladex of retardation you flip through when commenting.

    No matter how it plays out in the courts, one thing’s for sure: Samsung will think twice in the future before just ripping off from Apple’s designs. 

    Apple’s goal is to simply make it economically unfeasible for Samsung to blatantly ripoff and now they are even embarrassing them in the eyes of the industry and consumers. After all, the law is on Apple’s side till now and Samsung is guilty of being lazy, if not outright thieves.

      Apple really isn’t all that innovative design wise. Minimalistic and modern is designed to be simple. Simple is easy. What they have done is patented/trademarked a shape/rectangle with a 1.5″ border.

    I get going after someone who has “ripped you off”, but the question I have is this:

    Why isn’t Apple going after Motorola for the Xoom?  Or Asus for the Transformer?  Or HTC for the Flyer?  Or the laundry list of other manufacturers cranking out Android Tablets that “look like the iPad”?

    Apple copies,polishes and sells at a premium.Compare the Creative NOMAD with the first generation Ipod and you will know what am talking about.Ok,thats a decade ago many might not remember.LG Prada and Iphone?I own 2 iDevices but i believe Apple is unfairly bullish in this.

    Whether you love Android or Apple this is still just a sad day for everyone. The day that one company can keep consumers from choosing what to buy is a day I’d rather not have. The biggest shame of all is the absolutely BS patent system we have throughout the world. This goes for all manufacturers. Some patents are so vague and general in nature that they should never have been passed. 

    Honeycomb does suck however. I own a Galaxy Tab 10.1 and an original iPad. I prefer bits of both. I hope Ice Cream Sandwich address’s things.
