Apple (AAPL) asked the United States District Court for the Northern District of California last month to add several recently released Samsung products such as the Galaxy S III mini to its ongoing patent infringement suit. Reuters now reports that the company has agreed to drop the mid-range smartphone from the suit, however, after Samsung (005930) said it is not going to be sold in U.S. market.
Apple previously argued that it was able to purchase “multiple units” from online retailers such as Amazon (AMZN) and have them delivered in the U.S., but Samsung said it is not officially “making, using, selling, offering to sell or importing the Galaxy S III Mini in the United States.” On those grounds, Apple agreed to withdraw its patent claims, “so long as the current withdrawal will not prejudice Apple’s ability later to accuse the Galaxy S III Mini if the factual circumstances change.”
Apple and Samsung’s latest spat is scheduled to go to trial in March 2014.
