Class-action suit filed against RIM after BlackBerry outage

BlackBerry users have filed a class-action lawsuit against Research In Motion after the company’s massive service outage earlier this month, the Financial Post reported on Wednesday. The suit was officially filed by the Consumer Law Group in the Quebec Superior Court “on behalf of individuals who have BlackBerry smartphones and who pay for a monthly data plan but were unable to access their email, BlackBerry Messenger service (BBM), and/or Internet for the period of October 11 to 14, 2011.” It specifically focuses on “RIM’s failure to take action to either directly compensate BlackBerry users or to indirectly compensate BlackBerry users by arranging for wireless service providers to refunds their customers and to take full responsibility for these damages.” RIM’s BlackBerry outage lasted several days and spanned around the globe. The company’s co-CEO Mike Lazaridis offered a public apology and RIM has offered limited free tech support in addition to a number of free “premium apps” as compensation, however, RIM currently has no plans to reimburse customers for the downtime.

    Seriously?  Move on people.  Its a cell phone.  There are more ways to check email than a cell phone.  I understand the frustration, but filing a class action lawsuit is a bit much IMO.  You really want to show your frustration?  Move on to another platform and leave BB (if you can)

      I can say that most if not all of the people who filed the lawsuit are more than likely not using their service anymore, but will seek compensation for their lost time. Class action lawsuits are what keep corporations in check.

        nope…there is a reason why the carrier service agreement is multiple pages of text in 6 point font.  They cover their asses for EVERY little thing that can come up.

      Chris, many of us use our Blackberries for business. During the outage, It was not immediately apparent my emails were not going to the clients I was sending them to. Bottom line, I lost money and also appeared irresponsible to my client who did not hear back from me.
      I said this before, RIM should at least try to send a message to everyone’s phones, warning us of these outages.

        but this is a slippery slope.  Granted RIM has had some issues with BIS, but why not start a class action every time a carrier has an issue with connectivity, dropped calls, data etc..

        i think it is more to the fact that you have to pay extra on most carriers to have the BIS service and even more to have BES service

    Blackberry obviously cannot directly offer refunds to it’s users.. It is not practical.

    Can Blackberry tell the zillions of wireless carriers to bill them for all their blackberry customers for a month? Probably.. but still not practical.

    the fact that blackberry apologized.. gave free apps out etc.. I think was a good and satisfactory response.

    But then, these people belong to the entitled class.. and have zero tolerance for any error or mistakes. Screw them!

    My phoned didn’t even go out. However, I have to say the free apps I was offered are quite lame. Give me all of “documents to go” and I would be happy.

    I detest these class action lawsuits. The lawyers make all the money. It isn’t like RIM needs to be taught a lesson. They know damn well about the problem.

    I honesty hope RIM grows up a little because all that’s going on. The fact they have outages all the time (and yes they do – just not as widespread as this last one) should tell people that (RIM) isn’t keeping up with anything in the tech world and have completely lost touch with their customers. I don’t hate RIM, but they seriously need new management before they go out of business
