After successfully filing for an import ban against Samsung, which was recently upheld by the U.S. government, Apple is looking to add insult to injury by appealing elements of the International Trade Commission ruling it does not believe are harsh enough. Florian Mueller of FOSS Patents discovered the appeal on Tuesday, which “could theoretically result in an import ban over up to three more patents, a reversal of the ITC’s decision to clear certain workarounds, and […] a technically broader ban.” Mueller believes that Samsung will appeal in the coming weeks as well, and as the legal war continues, Apple will sharpen its focus on battles that it can win. The ITC ban only affects older Samsung phones as it stands, but if Apple’s appeal does in fact broaden the ban, Samsung’s current U.S. handset lineup could be in peril.
