Samsung sues Apple to block iPhone 4S sales

Samsung recently filed lawsuits in Japan and Australia in an attempt to prevent Apple from selling the iPhone 4S. In addition, Samsung is seeking to block the sale of the iPad 2 and the original iPhone 4 in Japan, Bloomberg said Monday. In September, the South Korea-based phone maker also filed motions to ban the iPhone 4S in France and Italy. “Apple has continued to violate our patent rights and free ride on our technology,” Samsung said. “We will no longer stand idly by and will steadfastly protect our intellectual property.” Apple filed similar lawsuits against Samsung in the United States, Australia, Japan, France and the Netherlands. The iPhone maker successfully prevented Samsung’s local subsidiaries from selling the Galaxy Tab 10.1 in Australia and the Galaxy S, Galaxy Ace and Galaxy S II in the Netherlands. Samsung recently announced that it will tweak its the aforementioned smartphones in an effort to dodge the European sales ban.

        I think they are doing exactly what was done to them. They are filing for devices to be banned based on their patents that Apple currently isn’t paying licensing fees for. I’d say they are in the right for suing based on that only. The patent in question for those who aren’t blindly supporting Apple is on 3G radios. Yeah, Samsung owns the patent on 3G radios.

        @twitter-133878082:disqus The problem being that Apple doesn’t make 3G radios, but buys components whose manufacturers likely already pay a licensing fee to Samsung (if Samsung truly owns patents that are licensed industry-wide under FRAND), meaning Samsung is attempting to “double dip”.

        I think Samsung and Apple are playing a game with billions of dollars at stake.

        In the Apple environment, when you buy an iProduct, it locks you into iTunes, App Store, etc.  Apple makes money off your digital purchases. There’s A LOT of money to be made here. Blocking the import of the Galaxy Tab 10.1 impoves the sales of the iProducts.
        Samsung wants in on this action to get some of our cash.  They’re no better than Apple.  I think these lawsuits are stupid, on both sides.

        One can view Samsung’s lawsuits just as a legal actions as a defense against Apple.  If Samsung wins, both companies will heavily lobby the government to alter the patent laws so both products will eventually be available again.

        No. The S and SII have sold 30 million total. Samsung is bragging they sold 3m SIIs in 55 days. How many 4Ss did Apple sell this weekend?

        Wow a whole 30 million, took quite a few months to hit that number.  You would think 30 million is a whole lot, but with thin profit margins, it’s not all that great.   The iphone 4S will sell far, far more then 30 million and do it in a shorter amount of time!

    I think that Samsung is doing this poor show trying to elevate the pride, but it has lost almost all rounds, I don’t expect that Samsung gives up soon, but the later the worse for the korean pride, I hope koreans don’t do Seppuku like japaneses, somebody at Samsung will feel the iron cutting his/her throat.  Too much noise about patents and useless thing, it would be a lot cheaper for Samsung to admit it ripped off the iPad design and change the form factor and launch its galaxy whatever it called to the public, sammy is losing money and respet. Until now sammy hasn’t probe to be a good patent fighter, maybe Google will land a tree like it did with HTC.
