Samsung seeks to block iPhone 4S sales with new patent complaints

Samsung filed two separate motions for preliminary injunctions in Paris, France and Milan, Italy on Wednesday seeking to block the sale of Apple’s upcoming iPhone 4S in each respective market. The company confirmed the complaints on its corporate blog on Wednesday, just one day following the unveiling of Apple’s next-generation iPhone 4S smartphone. Samsung’s motions allege that Apple’s new smartphone infringes on two Samsung-owned patents related to communications over WCDMA cellular networks. Read on for more.

“Apple has continued to flagrantly violate our intellectual property rights and free ride on our technology,” Samsung said in a blog post. “We believe it is now necessary to take legal action to protect our innovation.”

The move is hardly unexpected. Reports surfaced last month suggesting that Samsung was already planning to target Apple’s then-unannounced next-generation smartphone in a new wave of patent attacks, and Samsung went on record days later stating that it planned to turn up the heat in its ongoing patent disputes with the Cupertino, California-based tech giant.

    i’m thinking that’s apple’s plan all along.
    They won’t be happy until samsung, HTC, and Motorola are forced to adopt Palm OS 6.

    This isn’t about innovation, or stealing of “icons”  This is a business strategy that apple chose to undertake to mitigate androids ever increasing market share.  They realize that in terms of total % of mobile platforms, iOS can’t compete with an open source OS that’s open for any manufacturer to use.
    So this is the plan.  However, it would have served them better if they actually found some technology to sue about.  I’ve yet to see one lawsuit that involves actual technology.
    If you can’t patent a dress or shoe design, you can’t patent icons, PERIOD.

      I’m Korean, don’t call me stupid.  And the EXACT same thing can be said about APPLE.  Who the hell do you think wants to shake hands with Apple now?  Motorola?  HTC?  Samsung?  HP?  RIM?  Nokia?  
      Instead of partnering, they went out and litigated against these companies.  Microsoft and Google have a better shot at making handshake deals now that apple has decidedly said to themselves “we don’t need anybody else, we’re better than everyone, and we’re going to sue the pants out of anybody who would dare to compete”
      In an industry filled with competition and start ups, the smart business strategy is to make partnerships. Once smaller companies build a patent portfolio large enough, don’t be surprised if they team up to bring the wood to Apple in order to protect themselves. Naturally, every handset manufacturer out there within Apple’s sights will eventually feel the need to share information across companies in order to protect their interests. What do you think will happen when google+ibm’s patents, moto, samsung, htc, and other Chinese start ups start to share patents? You think apple would try to touch that? How about an android product development consortium?
      I’d love to see Cook try.

    Apple made their own bed, wet it, and now have to lie in their own filth.  Apple copied the iPad design from the movie 2001 (& I hope they get sued for that as well).  Apple sues everyone out of fear because of their lack of imagination. Them suing Samsung over the basic shape of a phone would have been like Henry Ford  suing other manufacturers for making cars with 4 wheels. What did they want, star shaped phones with razor sharp edges? Now they will be righteously left in the dust with their boring teenie bopper blob and will never be able to use a fresh cutting edge shape like say oh….the NEXUS PRIME- which is going to stomp the pathetic sheeple lemming iphone further down into its own self-deficated steaming pile of smugness.
