AT&T asks judge to toss Sprint lawsuit

AT&T has asked a federal judge to toss a lawsuit brought against it by Sprint, Reuters reported on Friday. Sprint filed its lawsuit on September 6th and said it was fighting “on behalf of consumers and competition.” Sprint also argued that AT&T’s planned acquisition of T-Mobile USA is “illegal.” As one might expect, AT&T does not see eye-to-eye with Sprint on those allegations. “Sprint cannot wrap itself in the cloak of wireless service consumers’ interest because Sprint is not a consumer but instead a competitor in the sale of wireless services,” AT&T said in its court filing, noting that Sprint’s argument has a “lack of standing.” AT&T also responded to Sprint’s lawsuit earlier this month when it said: “This simply demonstrates what we’ve said all along – Sprint is more interested in protecting itself than it is in promoting competition that benefits consumers.” Sprint is not alone, however. The United States government filed a suit against AT&T in an attempt to block the merger in late August.

    As much as yo may hate it this merger is a good thing.  T-Mobile is on the decline and Deutsche-Telecom has been wanting to pull the plug for the past year or two and get out of North America. 

    The merger will suceed and go through despite Sprints objections.  Sprint also doesnt have the capital or resources to purchase TMobile if the deal falls through which it wont.

      T-mobile is not gonna fall through, there are other companies beside sprint and ATT who can buy T-mobile. On the other hand ATT buying T-mobile will just help create a monopoly. I see sprint failing soon too at this rate so it will only be Verizon and ATT left. Then prices will skyrocket up for both and more restrictions.

    It’s well known that at&t spends the MOST time commenting on shit that should concern them the LEAST. Worry about the business at hand (FCC/DOJ). You were sued by other wireless carriers too, when are you gonna get to them?? POS carrier..!!

    I hope the judge decides to allow the case to move forward. I have AT&T and have no issues with them, but I think this merger is a bad idea.

    Sprint is its own company with its own special interests.  Whether or not you are for the merger you have to admit that Sprint is not and should not interfere with the decisions of the DOJ.  

    Sprint can object all they want on the sidelines, spread FUD on the internet, Facebook, Twitter… wherever… cause it’s their right to free speech but beyond that they are simply interfering with the justice system.

    I think Sprint’s biggest issue, besides getting heartbroken over T-Mobiles decision to sell to AT&T instead of them is that they don’t have the cash to build out or grow at the rate AT&T can.  Even with their network vision plan, EVDO REV B rollout, LTE rollout, iDEN phaseout, CDMA Direct Connect rollout etc. they still feel they are at a disadvantage and they want the govt. to intervene and save them.  

    But like Sprint has proven throughout the years it’s not AT&T that they need to be saved from it’s themselves. Incompetent management decisions have left them where they are now and they are paying the price.  No govt. cheese intervention can help them.  What they need is for their board to kick out their management team and start clean.

    So, how exactly does AT&T’s acquisition of T-Mob promote competition??

      That’s for the DOJ to decide not Sprint.

      AT&T is simply pointing out what a hypocrite Dan Hesse and the rest of the Sprint klan.  

      Sprint was allowed to take out a national competitor (Nextel) and tried to take out another (T-Mobile).  Same BS hypocricy different day.

    AT&T has not spent nearly as much as their competitors upgrading their network for many years (go compare their annual statements to Verizon), and now paying the price.

    AT&T should take some of that 100 billion plus in revenue and fix its own network. Sprint uses it own money to prepare for disasters, improves its network in certain markets, scholorships, sweepstakes, Nascar events for customers and countless other things. It does this every year and loses a billion dollars a year. SO WHO ARE YOU FOOLING AT&T? INVEST THAT WINDFALL YOU GET FROM YOUR CUSTOMERS. YOU WILL ENJOY SOME SUCCESS. YOU DO NOT HAVE TO BUY T-MOBILE TO ACHIEVE THIS!!! What does Apple do with their 77 billion in profits for their customers? I know. Charge you another 600 bucks if your Iphone breaks and you do not have insurance to cover it. What does Verizon and AT&T do for your money? I know. Expensive plans and excessive charges and phoney baloney in the billing dept. Finally, this lawsuit is not for just Sprint. It is for them, the industry and consumer throughout the United States!!! Why should Sprint and T-Mobile go out of business so that you, Verizon and Apple can thrive and prosper?

      Apparently Sprint is using your Nascar and scholarship money (to the count of 200 + million) by lobbying against AT&T.  

      Sprint has been behind in deploying backhaul and next generation networks so they have themselves to blame.  

      Apparently AT&T is using some of its revenue to buy T-Mobile USA.  $39 billion is really nothing to them especially since they are buying a paying subscriber base of 30 million users and over 40k cell sites.  

      Sprint will have to file for Bankruptcy after taking out loans to cover up the swiss cheese WiMax network with someone else’s LTE network (like Lightsquared or Clearwire)
