Samsung files new complaint against Apple in France, says iPhone and iPad infringe patents

Samsung on Monday confirmed that it recently filed a new complaint against Apple in France, alleging that the Cupertino-based company’s iPad and iPhone devices infringe on three Samsung-owned patents. Unlike the case that recently saw a German judge ban sales of Samsung’s GALAXY Tab 10.1 tablet by the company’s local arm, Samsung’s complaint in France covers patents rather than the physical design of the devices in question. The suit targets Apple’s iPhone 4, iPhone 3GS and iPhone 3G as well as the iPad and iPad 2, and the patents in question cover the UMTS communication standard according to AFP. The complaint was first filed in July and a preliminary hearing will take place in December.

    If they are complaining that Apple are infringing on a UMTS patent – they should be available on FRAND terms as they have been baked into the specification. Perhaps Samsung, like Nokia before them, wanted special terms with Apple and held back on the fair, reasonable and non-discriminatory terms they promised.

    We never did get to see what Nokia got for their side of the “win” a few months ago – apart from the pile of cash of course. Nokia wanted to have access to some of Apple’s, non-standards encumbered patents, but that probably went away when they signed the deal with MS and then wound up the Apple case.

    I would suspect that Samsung are trying a similar trick here. But we shall see.

      That’s right, they can not ban a product because these patents are part of the UMTS standard.  Once that standard is accepted then all a patent-holding company can do is sue to receive licensing fees.  They must negotiate these fees with fair and reasonable that are non-discriminatory, ie they can’t charge Apple higher licensing fees than Sony Ericsson, for example, just because Apple sells more phones.  Apple is already paying Nokia licensing fees for similar patents, so I wonder if Samsung can double dip there.

    I would like to know how Apple will affect Samsung in such a way that it will be dead in 2 years. The last time I checked Samsung was involved in
    Electronics, Shipbuilding, Financial, Chemical, Retail, Entertainment, Flash memory, Aviation, Optical storage, Mobile phones, Smartphones, Hard disk drives and Life Insurance with a net worth over $295 billion. So a little lawsuit by Apple over a phone is not going to cause then to lose any sleep and they certainly won’t be dead in 2 years. Wait I might be a little too advanced for you with this. I’ll let you keep playing video games in moms basement. Carry on.
