HTC responds to allegations that its phones are spying on users

HTC on Friday responded to user allegations that at least two of its smartphones, the HTC Sensation and the HTC EVO 3D, spy on users. BGR reported on Thursday that a new Android software update issued to these two handsets included tweaks that cause the OS to log users’ behavior. As discovered by InfectedROM forum member TrevE, Carrier IQ and four other processes in Android 2.3.4 purportedly gather usage stats and transmit them in the background. HTC has confirmed to BGR that these functions are all tied to an opt-in service however, and the Taiwan-based firm says it is not spying on anyone. Read on for more.

HTC confirmed to BGR that all of the data collected by the devices in question is encrypted, and any identifying data is stripped prior to transmission. Moreover, the vendor insists that the data collected by the processes in question is only sent to HTC if the user has previously opted in to an error reporting feature. “HTC, like most manufacturers, has an opt-in error reporting function built in to our devices,” an HTC spokesperson said in a statement delivered to BGR via email. “If your phone experiences an error, you have the option of ‘Telling HTC’ so we can make improvements to our phones. Details about this are in our privacy policy on each device and in order for data to be collected, you have to opt-in. If you do opt-in, we protect your privacy by de-identifying and encrypting the data.”

The statement goes on to reassure users that any data that might be transmitted with regard to the processes discovered on InfectedROM is tied to opt-in functions. The company also notes that none of the data is used to spy on users, but rather to investigate crashes and other unexpected errors. “HTC is committed to protecting your privacy and that means a commitment to clear opt-in/opt-out as the standard for collecting any information we need to serve you better,” HTC said in its statement.

      ZAPATITO, you are right.  If it’s Android or an Android OEM it’s the user’s fault.  If it’s an iOS device, it’s Apple’s fault!  Right on brother!

        There you go with all the other morons who stereotype about people. I have a Macbook Pro, and love the hell out of it. I do not own an Iphone, because I am sick and tired of seeing so many people with the same phone. I am currently getting the HTC Sensation in a couple weeks. I don’t dislike Windows 7, it’s acually great, but I love my mac. I have had it sense 2009, and ONLY 1 VIRUS!

    HTC gets worse by the day: First all their phones look the same. Two they have 1GB of flash in all there phones. Three they release a new phone with a bad name every week. And NOW they spy on their users? Damn HTC, you suck.

      They offer 1GB of flash for your system. On Android, the entire OS only takes up about 30% of that when its the latest version that is all flashy. My Droid Incredible has 8gb of additional flash storage to do with as I please, and it came with a 16gb SD card. You have never owned an HTC device.

        Only Apple forces the customer to live with whatever flash comes with the phone.

        MS says Win7 phones owners should not replace their SDHC card.

    I’ve noticed that Facebook for HTC Sense keeps turning the damn contact sync back on… i’ve disabled that thing almost daily until I just removed the account… maybe their in cahoots!!

      HTC has great phones, and i still have my incredible and love having 8gb internal memory. but for me the sync and facebook switch kept turning it self on. i also learned facebook has all my contacts! i took care of that then used rom other then stock and the problem was solved. so i guess you have to root and get a different rom

    It’s funny how people bitch about HTC having an error reporting feature yet MSoft and Apple PC/MAC OS have the same option when it comes to computers.  It’s different on a mobile OS simply because having to opt “yes” or “no” on a 3.5+ inch screen is much more of a pain in the ass than using your mouse to do the same thing on your PC or Apple computer.

    The people complaining think they are more important than they really are.  HTC doesn’t need your information you mouth breathers.  All of your info is probably provided by your carrier anyways so quit looking for civil suits and reasons to complain.  It’s a phone.  If you want more privacy get a free dumb phone or stop using your smart phone for everything you do in your personal life.  Access to the web means access to your personal info whether it be through TV, mobile phone or computer.  For people who claim to be so smart when it comes to an OS, device or carrier you MoFos are not the sharpest knifein the drawer.

    BTW…..you are probably the same people who cry when customer service takes forever to register a complaint.  If your device reports the incident it’s INSTANT.

    Actually….It’s not just device makers who do this….I’ve noticed while poking through some of the folders in the latest incarnations of the MIUI rom that there was a “debug” folder which uploads logs to  a designated dropbox folder…..I tried deleting the folder but each time I reboot the folder is automatically re-created.  As far as those who have rooted their android devices I recommend an app called LBE Privacy Guard.  It lets you permit or deny access of any app to specific permissions such as location, sms, phone id, and internet access.

    The bigger issue is privacy on Android in general.  I looked at switching from my iPhone but decided against it because I didn’t think I should have to root my device to get rid of apps that (insert carrier name) decides I get (read, “have”) to have.  Oh, and many of those apps don’t have just Internet access, but access to write to the SD card, read contacts, read SMS, etc.  That is crap.
