Apple allegedly doctored evidence in patent case against Samsung

Legal

Apple has managed to block sales of the Samsung Galaxy Tab 10.1 in Australia and in the European Union, but new evidence from Computerworld’s Dutch sister site Webwereld.nl suggests the iPad maker may be tampering with evidence. According to the report, Apple is using an image of the Galaxy Tab 10.1 that is purposely distorted to look more like the iPad. The Galaxy Tab 10.1 is presented with an aspect ratio of 1.36 (the proportions of the device itself, not the display) while the iPad is shown with a 1.30 aspect ratio. However, the Galaxy Tab 10.1 tablet itself actually has a 1.46 aspect ratio. “This is a blunder,” Klos Morel Vos & Schaap lawyer Arnout Groen told Webwereld.nl. “That such a ‘mistake’ is made in a case about design rights can scarcely be a coincidence. The aspect ratio of the alleged Galaxy Tab is clearly distorted to match the iPad more closely. Inasmuch as this faux pas will have consequences for the case is of course up to the judge. But at least a reprimand by the German court seems to be in order,” he added. Samsung is set to appeal the European Union ban on August 25th. Read on for a comparison image of the alleged doctored Galaxy Tab 10.1 next to the real one.

Wait a minute.  Are you suggesting Apple has a patent on screen dimensions?

  • Canuck166

Really a different aspect ratio equals “doctored evidence”? That’s a really big stretch and hardly relevant to the overall similarity of the two tablets. No idea what they can protect though legally.

Apple will sue all the existing picture editing programs..!!

A simple trip to best buy could have solved all this. Wow what a epic waist of time for atleast some of it to be over…… Geometry. After owned an ipad and currently owning a g-tab i know for a fact they are nothing alike. They truly are apples and honeycombs, completely different in every way.

apple is a bunch of evil mofos, but I already knew that waaayyy before I read this article. If they wanted to they could get a patent for steve jobbs’ balls….. and then come after all of us… they copied apple they all have 2 balls also, get them!!!!!!!!!!!!!!!!!!!!

Sorry, but Samsung should have caught that. Yeah, Apple is dick for pulling a stunt like that, but you can’t miss a massive oversight like that when you’re livelihood is at stake…

    Tsk-tsk all around.

Samsung had no idea that this was even going on. That is why the court date to cancel this is not until the 25th.

    1)modify aspect ratio
2)remove the “Samsung” that reads on the front
3)open the app drawer to make it look more similar
4)turn it 90° (it is always shown landscape in ads)

Everyone copies Apple – so there!

And where did Apple find the inspiration for the original Apple Computer Lisa graphical interface and a mouse pointing device?  Neither Apple or Microsoft can be accused of being too ashamed to use good ideas from others.  Read on defenders of Apple,

“Members of the Apple Lisa engineering team saw the Xerox Star at its introduction at the National Computer Conference (NCC ’81) and returned to Cupertino where they converted their desktop manager to an icon-based interface modeled on the Star. Among the developers of the Gypsy editor, Larry Tesler left Xerox to join Apple in 1980 and Charles Simonyi left to join Microsoft in 1981 (whereupon Bill Gates spent $100,000 on a Xerox Star and laser printer), and several other defectors from PARC followed Simonyi to Microsoft in 1983.”

And Xerox was rewarded with stock.

There’s nothing illegal with copying an idea. It’s called inspiration.

It is illegal to copy a specific method or implementation of said idea if it has been patented.

In other news.  Chocolate sues Vanilla for patent infringement.  The patent in question is for “A creamy and cold delivery of sugary satisfaction.”  Courts all over the world rule in favor of Chocolate.  Vanilla contends that they are distinctly different.  Judge notices that his vanilla ice cream evidence is covered in hot fudge.

I just paìd $22.85 for an ìPad 2-64GB and my girlfriend loves her Panasonic Lumix GF 1 Camera that we got for $38.78 there arriving tomorrow by UPS. I will never pay such expensive retail prices in stores again. Especially when I also sold a 40 inch LED TV to my boss for $625 which only cost me $62.81 to buy. Here is the website we use to get it all from, CentHub.còm

Two things in life that are certain:

    1. Google doesn’t ever lie
    2. Apple ONLY lies

That’s all you have to know…

Apple is not a company that I like. But I don’t thing they would be stupid enough to pull a stunt like this. So many nasty, damaging consequences can come out of such (allegedly) blunder that — if it’s true — they will probably blame a over-zealous employee (or attorney). Not to mention horrify their own customers…

I’d like to think Steve Jobs would not allow a stupid move like that.
    To be watched closely.

“…least a reprimand.”  Seriously?  The case should be thrown out and Apple charged for perjury.

Come on now guys, that’s not cool.  Can’t we all just be friends?  My Macbook Pro and my Galaxy S II get along just fine.  Plugging in, transferring files, sharing internet….they’re in love.

  • Demofya

Yea, that seems like something a Niche corporation would do once they realize their competition is about to win. Face it fan boys, Apple is a market item that trends… however its not going to be around the top for much longer. The moment it becomes apparent that people can obtain better products for less, Apple wind up in the same hole it was in back in the 1980′s when MS took over the marketshare penetration.

  • Justin

Oh man there’s an I in my name..guess apple is taking me to court next
