Samsung to appeal EU Galaxy Tab 10.1 ban on August 25th

Samsung will appeal a recent ruling by The Regional Court of Düsseldorf in Germany that bars the South Korean tablet maker from selling its Galaxy Tab 10.1 device in the whole of the European Union except for the Netherlands, The Wall Street Journal said on Friday. The appeal court date is set for August 25th. Samsung could face fines of up to $350,000 per unit if it continues to sell the device in the European Union. On August 1st, Apple also blocked Samsung from selling its tablet in Australia until courts rule whether or not the device infringes on 10 of Apple’s patents. Apple has a similar case open in the United States in which it has accused Samsung of creating copycat devices of its iPhone and iPad. “Rather than innovate and develop its own technology and a unique Samsung style for its smart phone products and computer tablets, Samsung chose to copy Apple’s technology, user interface and innovative style in these infringing products,” the complaint said.

    Samsung should have been allowed to defend themselves before this ban was arbitrarily put in place! Your honor, we know we are using a stolen OS from oracle, we know we are using a stolen design from Apple, we know we are using a stolen UI from apple, but we are …..uhhh.         I think apple has made their case. If you are too lazy to read up and make an informed opinion then maybe you should not comment. I happen to agree with apple others agree with samsung. How can they settle this dispute? Amazingly there is a legal process that allows for a resolution.  true story™©®

      This just in….Apple now owns the intellectual property for the “Rectangle” and the color “Black”.  Up to this point no device, item, or item from nature has ever possesed that shape.  Anything shaped like a rectangle must pay a royalty to Apple.  Hersey has already agreed to reshape their candybars to comply.  All items in the world whether manufactured or naturally occuring in nature cannot legally be black, only shades of grey.  Steve Jobs couldn’t be reached for comment as he was too busy monopolising the technology world with his army of puppy-eating patent troll lawyers.

        Do you realize samsung halted their galaxy tab after Apple announced their product on march 11..the phone situation is kind of stupid on apple but they even made it public to hold back on the launch of the tab after the iPad 2 was launched..there is no denying they copied the iPad 2..but for the rest of the phones…no soo much

      Lol. I hate ur guts Scroat but yes samsung is guilty here. I was in best buy the other day when I picked up what I thought was an iPad. Took me a few seconds even after I started to play with it. The icons even look the same. Truer story

        The other day I picked up a red iPad that had 2 knobs on it.  Turns out it was an etch-a-sketch. I think Apple stole the rectangular design from them.  Really confusing.

        My bad. Meant to say that I picked up a galaxy 10.1 it really does resemble an iPad. Silver back, thin, icon arrangement, icon design. Separately I think it’s fine but when u add all the similarities together in one device it is MY opinion that samsung deliberately copied apples iPad. You may not think so but that is the beauty of America. U can have an opinion. Truer story ™©®

        Do u understand that samsung made it public that it had to go back to the drawing board after iPad 2 was announced…they copied the jpad2…the asus transformer doesn’t feel nor look like it…either does the touchpad..nor acer…samsung copies designs

    Everything that has to do with intellectual property has to be completely reformed in today’s virtual age.

    I saw an interesting segment on the morning news today regarding Christian Louboutin shoes. For those uninitiated in fashion trends like me, he was the designer that first put red bottoms underneath high heels. He’s suing Yves Saint Laurent, another high end fashion company because they also are producing shoes with red bottoms.

    Louboutin’s argument (which should sound vaguely familiar to you), is that people associate the red bottom heels with his brand, and may get “confused” when purchasing from YSL.

    What I found interesting, was that in the context of fashion, the general feedback by all the people featured in this news segment, was that, yes, Louboutin may have first used red bottoms on heels, but A. you can’t (or perhaps shoudlnt?) trademark an aesthetic that’s not tied directly to a proprietary entity (like a logo) and B. the whole argument is based on the assumption that even the stupidest of people don’t realize that they’re walking into a YSL store, paying money for a shoe labeled “YSL”, packaged in a box that says “YSL”, placed in a bag lableled “YSL”, with an accompanying receipt that says “YSL”…. go home.. and go “oh shit, this ISNT REAL LOUBOUTIN??????!?!?!”. 

    If Apple wins any legal battle over the use of things like the size, shape, and color of a phone in a genre that’s all basically a slab of screen with a bezel and/or anything that has to deal with Samsung copying Apple’s UI aesthetic (which we all know they did, that’s not what’s being discussed here)… then by all accounts, Microsoft should be able to go back and place a permanent injunction on OS X halting all Mac sales for the use of a windowed OS interface. Better yet, Xerox should sue the pants off of Windows AND Mac AND linux, since they came up with the windowed UI.

    Palm shoud also sue all smartphones for developing a gridded icon layout first. 

    What Google said about patent trolls like Apple rings very true (albeit, obviously self serving), less suing, more innovating. It’s quickly becoming a cliche, but it doesn’t make the point any less relevant.

    If someone can patent a black rectangle, then out patent system is absurd.  Can you imagine if some TV maker patented the black bezel TV?Speaking of which, Samsung should make their tablet look just like one of their TVs from 2006 before the iPhone existed like the LN40A550.  In fact Samsung should sue apple for copying it’s black rectangle TV design.

    By the way, I just paîd $21.87 for an îPad 2-64GB and my boyfriend loves his Panasonîc Lumîx GF 1 Camera that we got for $38.76 there arriving tomorrow by UPS.I will never pay such expensive retail prices in stores again. Especially when I also sold a 40 inch LED TV to my boss for $657 which only cost me $62.81 to buy.
