Apple blocks Samsung from selling Galaxy Tab 10.1 in Australia

Apple has inked an agreement with Samsung in Australia that prevents the South Korean company from selling its competing Galaxy Tab 10.1 tablet there. According to Bloomberg, Samsung cannot sell the tablet until Australian courts rule whether or not the Galaxy Tab 10.1 infringes on 10 Apple patents. Apple alleges that the Galaxy Tab 10.1 copies the touchscreen tech found on the iPad and also has the same “look and feel.” Samsung agreed not to advertise the device and Apple said it will pay damages should Samsung win the case. The two companies also have a number of ongoing legal battles in the United States and elsewhere. In April, Apple filed a lawsuit against Samsung and claimed the South Korean company had created a number of “copycat” devices. A court ruling forced Samsung to show Apple its new line of phones and tablets, but a Samsung request to see the new iPad 3 and iPhone 5 was shot down.

      I just paid $ 22.87 for an iPad2-64GB and my girlfriend loves her Panasonic Lumix GF 1 Camera that we got for $ 38.76 there arriving tomorrow by UPS.         Yes, but did you confuse the two. Did you look at the two phones next to each other and feel like you wouldn’t be able to tell them apart? Do you know anyone who isn’t/couldn’t be/wouldn’t be able to tell them apart?

        I know Apple fanboys are going to murder me for this one, but this whole situation makes me feel like Apple is suing because they don’t feel that they can sufficiently differentiate their product. I mean, if I know that I’m going to do something new tomorrow, why should I care that you copied what I did yesterday? If anything, I should be mocking you for not being able to innovate, not suing you and complaining.

You’re telling me that, all of a sudden, people are choosing the Galaxy S over the iPhone because it looks close enough? That’s what you’re going with? I don’t buy it for a second. I’ve seen people go from iOS to Android. I’ve seen people go from Android to iOS. But I have yet to hear of anyone who went with an Android phone that looked close enough to iOS.

        Is Apple saying that all the money and time that they’ve spent on advertising — talking about how they’re often imitated but never duplicated — has been a total waste of time? I feel like that’s what that lawsuit says. And while I’m an Android fanboy, I feel like that’s bullshit. Nobody’s mistaking an Apple product for anything else.

        1. Newton (magic)
        2. Palm Pilot (knockoff Newton)
        3. Treo (upgraded palm pilot, so knockoff newton still)
        4. iPhone (magic!)

        No one else created anything of value to add to this evolution? No one tried out things that were obvious missteps that other companies were able to see and capitalize on? No Windows Mobile anything? No RIM? No iPod? No Toshiba Gigabeat?

        I’m guessing you really haven’t been following the breadth of these products for that long, because it seems like you think things are magical and original because you never actually used all of these projects

        Did you use the Netwon and then the Palm V?  Palm V = more refined but the same idea
        Handwriting + PDA but in a slimmer nicer case.

        Did you use the BlackBerry Curve 8300 and then the iPhone?  iPhone = more refined but the same idea
        PDA + Smartphone but with a touch screen and better browser

        iPhone and Galaxy S . Galaxy S = more refined but same idea.
        Touch Screen Smartphone + Apps  but with options for different hardware configurations (because let’s be honest, phones have never been one size fits all)

        Their apps look the same? Since when did developers not want consistency across platforms? How is that Samsung’s fault? And may apps look different on iPhone/Android.

        Is you complaint going to be that they have app icons in a grid? That’s copying the look and feel? Well even that’s implemented differently (and arguably better as the App Drawer allows you to have more apps without them getting in your way)

      I agree with your sentiment but what Apple is trying to do is stop the growth of Samsung products to protect margins.  Samsung is a formidable competitor and I think their products are “close enough to Apple” for most people.  Samsung will have absolutely no problem at all reducing price and selling a ton of product.  Given function and price, many people are going to choose Samsung over Apple.  That is already happening as sales growth for Samsung dwarfs that of Apple.  If you’re Apple you have to protect your brand and your margins.  The last thing Apple wants to do with Samsung is compete on price.  If the products are “close enough” price becomes the only significant differentiation.

      I have always argued Apple has a very, very vulnerable business model because it is dependent on people paying a premium price for products that increasingly become commodities.  Either margins or sales have to fall.  Given the history of Apple, my guess is sales fall.

       Galaxy Tab 10.1 infringes on 10 Apple patents. Why do Android boys get hung up on the “look and feel” it is basically the salad, got dive into the meat & potato’s once and awhile. 
      Apple agreed to pay loss of sale damages, which will be huge if they lose. Also what BGR left, Samsung is releasing a non-U.S. version of the tab 10.1 and it will give Apple three units to review, a hearing is set for Aug 29. Should the revised device believed to be infringing, they will set up a trial date on the 29th. If not, they will get to sell it.

        Very true, I was actually projecting the huge from a long term loss. Say the court restricts the sale of the revised tablet, takes it to trial. It is a lengthy process and that is where I figured it could be huge. Granted huge for Apple would be something like $20 Billion. Any claims in the millions or less is basically loose change in the sofa to them.

    Okay, I am truly sick to my stomach regarding apple and thier constant policy of sue everyone. As a proudowner of a Galaxy tab 10.1 it looks and feels NOTHING like the ipad. Of course it’s thin, thin is in, but where is it gonna stop. Is apple going to sue Motorola when they release their next tab which will be thinner than the first xoom. Why doesn’t samsung sue Lg, and Lg sue sharp, and sharp sue vizio all for making thin lcd televisions. As far as looks go the ipad is very diferent from the galaxy tab. Apple is a company that prides itself on dictatorship. You will do what we want and how we want you too. Apple is scared and I mean truly scared of competition and rightfully so.

    Apple has not innovated anything. They take concepts from other companies tweak them and patent them.and call it innovation. I hope when all of this is said and done, apple pays samsung a large sum of money and this patent stuff can just die. Apple needs to shut up, truly innovate and stop BITCHING. Samsung should have told them to kiss their korean ass now it looks as if they are guilty of something when they are not.       In my opinion – nothing like how they do now (both from an industrial design perspective and user interface).
      Coke has copyrighting a shade of red.  Monster sues any company who uses ‘monster’ in the title of a product.  I don’t see Apple’s lawsuit as without warrant.  To me this is typical Korean behavior.  Just like Hyundai blatently ripping off the ID of Mercedes – Samsung has done the same.
