HTC willing to bury the hatchet with Apple in patent battle

Legal

Speaking with Bloomberg recently, HTC’s chief financial officer Winston Yung said that his company is open to cutting a deal with Apple over various patents the two companies are currently fighting over. “We have to sit down and figure it out,” Yung said. “We are open to all sorts of solutions, as long as the solution and the terms are fair and reasonable. On and off we’ve had discussions with Apple, even before the initial determination came out.” Earlier this month, an International Trade Commission judge ruled that HTC was infringing on two of Apple’s patents related to a “system and method for performing an action on a structure in computer-generated data,” and a “real-time signal processing system for serially transmitted data.” HTC said it would appeal the ruling, however, and Apple was also recently found guilty of infringing on patents owned by S3 Graphics, which HTC purchased in early July.

So they both were infringing on each other. Hhhhmmmmm I guess HTC is going to talk to them and say hey lets just agree to stay away from certain things and call it even. No need to continue wasting money fighting this out, you have your niche and we have ours.

I don’t understand. How can patent lawyers make any money out of this when Apple and HTC start talking to each other? What is going to drive this open discussion?

Just bury the hatchet and Apple with it. Move the development of the ‘Brave New World’ of new tech to Asia, far away from intertwined dinosaurs like Apple and Microsoft, just keep a line open to Google.

Of course you know tall-ships. Majestic. Beautiful. People love them. The best and greatest sail ships  there ever were. But they still are sailing vessels. The in hindsight inevitable victory of the steamships pushed the sailing ships development to it’s innovative limits. But productivity wise they soon became useless.

That is exactly what Apple products are. Beautiful. They look great. People love them and want to be seen carrying and using them. But they are already yesterday’s products. That is why Apple is shifting the battle to defensive territory. Now that they are ridiculously cash rich – always a dangerous position for a company to be in. In terms of the metaphor above: they sue others for using techniques that prevent ships from sinking, for the steering wheel, the use of a compass, for having windows etc. The battle will get a lot worse and uglier than it now seems to become. Because they are ridiculously cash rich, have a lot of cash to blow away. And when the dust settles..

If you have the guts, the nerve and capital to sustain a temporary loss: short Apple now. It is the best moment ever.

Being cash rich isn’t a dangerous position to be in.

Being cash rich merely means that the corporation is forging potentially more favorable investments, and therefore could be doing more.

Still better than not having cash.

HTC is going to burn.  Sad, but true.  Clout, they do not have.

    • Anonymous

You would probably like that because anything besides Apple needs to die, right?

        Don’t mind LouisLouis4.

That’s really him in his picture, by the way.

Steve Jobs is willing to bury the hatchet too HTC….right between your shoulder blades…….

    • Anonymous

That’s unfair. Apple is perfectly willing to bury the hatchet in your forehead.

As Apple’s newly hired CtO, Chief tAmpon Officer, I can unequivocally state, “We, here at Apple, are not interested in a truce of any kind. Our mission is to copy others’, claim their technology and, then, sue and fight to the death! We will continue to do this until we have eliminated any and all competition or threats. We, however, will not seek any action against Microsoft since they are harmless to our eco system.”

    PAPINYC, CtO

Funny that Apple will be making money on Android sales.

    • Drew

Not as much as Nokia will be making for every iPhone sold… Check. Mate.

Hey guys, look! It’s a person who has inside and unreleased information! Let’s listen to him!

    • Chut Pata

Microsoft is already making more money from Android than it is making from WP7.

    • Tim242

Not exactly. They each were found guilty of infringing on two of eachother’s patents.

It’s just a way of Apple saying, Pony-up bitch.

I just paid $22.87 for an iPad2-64GB and my girlfriend loves her Panasonic Lumix GF 1 Camera that we got for $38.76 there arriving tomorrow by UPS. I will never pay such expensive retail prices in stores again. Especially when I also sold a 40 inch LED TV to my boss for $675 which only cost me $62.81 to buy. Translation: You got us.

    • Anonymous

Yeah, but they’ve also got Apple, thanks to those S3 patents. The smartest move would be for them to both just turn a blind eye to all this infringement fuckery and continue making ridiculous amounts of money.

      • Anonymous

Not as much according to the newest ITC ruling. Two patents invalidated, the rest relegated to only Macs, and only those without Nvidia chips. Easy change.

Not exactly. They each were found guilty of infringing on two of eachother’s patents.

I wonder if HTC would be as willing if they hadn’t lost?

    • Anonymous

Of course not. But they’re figuring they’ve got something over Apple’s head with the S3 patents, so the easiest thing to do is for both of them to just stand down.

      • Anonymous

The recent ITC ruling reduces their claims for the S3 patents.

  • Bringit

Ohhh isn’t that sweet of HTC!

“Dear Apple, we know we stole your shit.  Our bad.  But whatever.  Before HTC gets even more publicly humiliated – how about we put this behind us?  No harm right?  Cool, thanks.”

    • Anonymous

So… in your reading, the S3 patents don’t mean anything? Now that HTC has taken that initial L, I’m guessing they’re going to try to use that as leverage to end this thing (relatively) amicably.

    • Tim242

Did you miss the part where apple stole shit that now belongs to htc? Thos crotch crickets are affecting your reading comprehension

  • Chut Pata

So Apple is suing HTC for something Apple itself stole from S3 Graphics? Cool!!!

    • http://identi.ca/LauRoman Laurențiu Roman

Didn’t they already do this already with a company that produced Basic for Atari and a company that makes copyers?

    • Anonymous

      Not… really…

This is not a good sign. The weaker party always looks to deal first. HTC has tipped their hand. I am worried android will be ganged raped in all holes before the dust finally settles. I’m so glad I’m getting the iPhone 5.

“system and method for performing an action on a structure in computer-generated data”
That sounds absolutely worthless. It sounds like someone’s patent-trolling.
