Personal Audio goes for round 2 after winning patent decision against Apple

Legal

Patent holding firm Personal Audio LLC is suing Apple for patent infringement surrounding IP covering playlist implementation on multiple Apple devices. The firm was recently awarded $8 million from Apple by a Texas judge who found that the Cupertino-based company’s iPod made unauthorized use of Personal Audio’s IP. Now, the firm’s new suit alleges that additional Apple products are infringing on the same patent. Devices covered in the new complaint include the iPhone 4, the fourth-generation iPod touch, the iPad 2, the fourth-generation iPod shuffle and the sixth-generation iPod nano. Apple has made headlines countless times over the past few months as a result of suing nearly all of its major mobile competitors for patent infringement. While some companies believe Apple should focus on building innovative products instead of suing all of its competitors, Apple seems to think its IP is being used illegally and therefore must be protected vigorously. Apparently, Personal Audio holds a similar belief.

Even though it is widely known that this site should be called iBGR, I guess I didn’t realize that everyone who posts on this site had to be an iSheep.    Funny how people can’t post negative comments about Apple… yet your buddies Scroat, Max, and all of the other iDoucher posse race out to RIM/BlackBerry/PlayBook articles and post negative comments constantly..

Lol I got a life..you’re the douchebag that made up a screen name against apple..apple doesn’t affect you in any way..the government..yes..apple..take your own advice

      • Applesucksfatties

You must be 8.. considering you can’t comprehend punctuation.    I wasn’t telling you to get a life.. hence the question mark..   And again, I didn’t realize I had to like Apple to post on iBGR.

On a side note – based on what you said about Apple not impacting me..  well, my screen name doesn’t impact you in any way, shape, or form.  So next time, instead of spouting your fat mouth, you can just choose to IGNORE my comments.

It is funny that you are spouting off on this blog trying to act all smart… but you are just another punk college kid without a degree (Mr. biotech senior) that has been brain washed by his buddies into thinking Apple products are cool.

ps.  Since you are still in college, are you still living with mommy and daddy too?

This isn’t the first Patent claim Apple has be guilty of moron and it won’t be the last.

      • Applesucksfatties

Hey capt dipshit…. I never said it was…   my comment “what comes around, goes around” is in reference to Apple’s Legal team working overtime to try to sue everyone…and getting what was coming to them in somebody suing them.

Look here Private Dickeater, Your comment is stupid because it isn’t like Apple just started file suits over IP. They are a publicly traded company and have a legal obligation to protect their shareholders money. Like every great company on earth has been doing since business began Apple two files lawsuits for IP infringement.

Quit being the dickrider that you are and understand it is just business. Apple wins some just like everyone else and Apple loses some just like everyone else. It has nothing to do with Karma for Douchenozzle, it is just business.

You know what, Go swallow another load of that green Android C.U.M..

      • Applesucksfatties

Baaah…Baaaah.   Apple is suing Amazon for using “App Store”… and a host of others for “infringing on their patents”… I better watch out, they might sue me for using the word “apple” or eating an apple.. or wearing an apple green colored shirt.   Is their next product going to be called the “iSue”?

    Misleading and false.

    Trolls trolling trolls.

don’t think it will win the second time, if the first suit was as broad as ” multiple devices” then, the second time around will get thrown out since these new devices were covered the first time around.

    • Anonymous

“The original suit only ended up covering the first six generations of the original iPod/iPod classic, all iPod minis, and the first five generations of the iPod nano, with Apple arguing that the newer products should be filtered out into a separate lawsuit (undoubtedly because they handle playlists differently than the older products). So, Personal Audio did just that with Apple’s latest-generation iDevices and threw in the iPad 2 for good measure (which was not mentioned by the original lawsuit). The company is now asserting one of the same two patents from its original lawsuit against five of Apple’s newer offerings. “

    They only won $8 mil?

    • http://infotainmentempire.blogspot.com Rob

yeah, I mean $8 million sounds like chump change for these kind of lawsuits.

Then again Apple only had to pay $947 or whatever it was for the “tracking scandal.”

    Good.

Apple should pay everything, every penny, but rivals stealing Apple’s IP should pay too, this is how the legal system works, it may look as a failure, but this is what companies have to deal with, but I would like to the Senate stops those Patent Trolls (companies that only exist to sue others) if any given patent doesn’t end up in a real invention, that patent should be abolished, how can a company that never (ever) produced or marketed any product sue other because it’s believed to infringed on an unused patent?

Ex.: Lodsy is not making applications that use their in-app patent.

    • Petshopmode85

But it’s the idea that counts………(jerk off motion)

  • Booboolala2000

    Epic fail for Apple.

  • Anonymous

Good for them. If Apple is found to be using their IP, Apple should have to pay. Tit for Tat and completely fair.

I wish BGR would reintroduce the dislike button that Disqus doesn’t have.  This way all profanity can be highly disliked and become invisible unless chosen to be seen.

I think I get all this suing going on now.  It is like a game of tag or pay it forward.  If you are sued, you must in turn sue someone else.

  • Anonymous

So lets see if I get this right.  Apple cannot come up with their own ideas for neither graphics and audio?  Thats some high quality thinking over there.
But this couldn’t happen to a more deserving company than Apple.

    belief.”

Or maybe, like Apple, Personal Audio never had an original idea either.

  • Fredd0

apple has to sue not only to protect their IP, but to keep up the show that they invent everything cool. if an isheep goes into a store and gets told by enough people that a device is just like and iphone or better than an iphone, they may begin to question their entire life. i mean, apple is their OZ and someone just showed them the curtain, so to save face, apple sues and says it was their idea first. the lemming sees the lawsuit and figures that apple must have had the tech first or why else would apple sue… after all apple is magical.
