Eric Schmidt: Apple is suing us instead of innovating, will make sure HTC doesn’t lose patent suit

Legal

During Google’s Mobile Revolution conference in Tokyo, Google’s executive chairman Eric Schmidt reaffirmed his company’s support of HTC and its other Android partners, ZDNET Asia reported on Tuesday. HTC is currently in the middle of multiple patent battles with Apple, and the U.S. International Trade Commission ruled on Friday that the Taiwanese firm was in violation of two of Apple’s patents. When asked whether Google would help HTC pay any fees associated with a guilty ruling, should the company’s appeal be shot down, Schmidt replied “We will make sure they don’t lose, then.” Schmidt attributed the lawsuits to Android’s massive global growth and restated that there are now more than 550,000 Android smartphone activations daily. “We have seen an explosion of Android devices entering the market and, because of our successes, competitors are responding with lawsuits as they cannot respond through innovations,” Schmidt said. “I’m not too worried about this.”

I paid $32.67 for a XBOX 360 and my mom got a 17 inch Toshiba laptop for $94.83 being delivered to our house tomorrow by FedEX. I will never again pay expensive retail prices at stores. I even sold a 46 inch HDTV to my boss for $650 and it only cost me $52.78 to get. Here is the website we using to get all this stuff, LiveCent.com

What about Apple’s newton tablet?  That surely predated windows mobile.  I would sue for use of IP if they would not license.  Capitalism at its finest.

Can you say with certainty that if Apple didn’t contribute everything they did since the iphone was announced that Google or another company would have done this?  Can you say that Android would have been where it is right now without Apple?  At least have respect for Apple for putting us on the right path.

EXACTLY! well said mr schmidt, about 1000x more candour than the evil and freakish mr jobs!

Apple owns that trademark and have to defend it or lose it.  I can tell you for sure that I have never heard a programmer refer to an application as an app before Apple started using the word.  Programs were called programs, applications, or exes.  Applications on windows end in .exe.  On Macs they end in .app.  Apple has been using app for ages.

How about windows?  What is more generic than that?  What about Palm?  I can go on and on.

I can’t fathom this Fanboy mentality of both iFans and FanDroids. Both companies serve a general purpose to the consumer. Apple with it’s great products and Google with online services that assist people in everyday tasks. Apple did make the smartphone mainstream with the iPhone. How? By using what’s out there (Nokia, Winmo, & RIM) and making it more accessible to the everyday people. Google and OHA further applied the same as Apple to release Android. I’m not going to take sides and claim which OS is better. The OS caters to different people. I personally use Android because I enjoy the UI and the choice to change it (without Jailbreaking and rooting). My computer is a iMac.

Are we all just to proud of something we own simply for bragging rights? I didn’t make iOS nor Android. Why cater to them like infants that we’ve nurtured all our lives? It’s a Smartphone that assists us in everyday tasks; not a child or pet.

Ohhhhh Scroatypooo-poo, I didn’t get hacked; that would be giving you iMorons way too much credit that, obviously, you don’t deserve.

Someone simply downloaded my avatar and created a false PAPINYC account with a different email, that’s all; it’s fairly simple to do and I’m flattered. Thank you.

I can no longer live a lie. Just as I have finally admitted my homosexuality I now admit that Apple is the best company and iPhone is the best phone.

They say the sincerest form of flattery is iMitation, I have been iCopied; which [is] consistent with crApple.

Anyway, I would like to thank Scroatypooo-poo aka Mobile aka Bringit (BABYYY); we are sincerely touched (no, not the way I touched your Mamma last night) by the gesture and will work even harder to serve all of my iSubjects.

I could understand if he thought the lawsuit didn’t have merit due to some inside knowledge he has.

But accusing Apple of not being innovative?  Really?

  • pir800

at risk of sounding like an apple fanboy, google needs to realize that they are stealing apple’s innovation. Maybe google is the one that needs to innovate.

  • Devore Irvin

    Heres how I see it.

    Apple-
They took the idea of what a smartphone was and innovated THE IDEA and came up with the iphone. apple may not have invented it but they polished it. and thats what they are selling. polish. their OS is polished and fluent. their apps are mostly polished and fluent. theyre like this because of the strict control they maintain on the OS as a whole.

    Google-
They took the idea of what a smartphone was, saw what apple did and had to come up with another way to make money. Apples revenue comes from apps and purchases of the like. at this time google cant compete with itunes or the app catalogue that apple has so they figured we sell what we know. ads. along the way they added widgets and other personalization options. im sure someone at google owned an iphone and critiqued what they didnt like about it.

apple sells polish and apps, google sells ads and personalization.

now about google about not innovating…
google has innovated in less obvious ways. for example~
-when they debuted turn by turn for FREE that was an innovative idea. they didnt invent the idea of turn by turn but by taking something as massive as that and making it free was pretty groundbreaking.

-google has also allowed app developers with different ideas to come to android. how many keyboard alts is there for iphone? widget options? home screen replacements? alt music players?

-google has allowed apps access to native features NOT JUST TWITTER.

-lets not forget how google popularized wifi hotspots and tethering

-obv the notification system that the iphone will be getting. you guys can argue your reasoning to worlds end but the notification tray looks like android. point. blank. period. i really dont care that apple hired someone who copied it to make it official. i have a problem with apple having the audacity to sue someone because “their product resembles an apple product”. really now?

about the tablet market is w.e to google. IMO i dont think they ever really wanted to do it but the OEMs kinda forced them to.

personally i have an android phone (G2) ive had a iphone and i prefer the G2. i like widgets, flash, my swiftkey on screen keyboard (that i paid for TYVM), my ability to share info with friends easily, and my uncluttered home screen replacement.

Yeah, and Google has never sued anybody. “Don’t run when you lose, don’t whine when it hurts. It’s like the first grade – nobody likes a crybaby.”  Anybody know who said that?

  • Drew

Copying what?? Turn by turn directions?? Speech to text?? Glass on the screen..?? I’m interested to hear what the myopic bunch of nitwits come up with because I’ve never heard an answer from anyone. And if all you have to say is the icon grid, please just shut up now.

I’m just waiting for crApple to sue Romy and Michele for taking credit for post-it notes.. when we all know that crApple invented them..

    Christie: So,
Mi-chelle! What are you up to?
Michele: Oh, okay. Um, I invented Post-Its.

    Christie: No
offense, Michele, but how in the world did *you* think of Post-Its?
Michele: Uh… actually I can’t take credit..  crApple actually invented them.

Let’s just quickly examine Apple’s and Google’s different approaches to bidding on the Nortel patents.  Google reportedly made bids that they thought would be humorous: Brun’s constant, Meissel-Mertens constant, Pi, etc.  Meanwhile Apple went into the bidding war to win it; they KNEW what the value of this IP is worth so they went after it and they succeeded.

To me this is a reflection on Google’s perception of IP.  They thumb their collective noses at it (for now) and clearly prefer to steal IP rather than buy it and/or license it.

BTW I keep seeing references to Apple using Nokia IP.  Quick history lesson:  that’s been resolved and Apple is paying Nokia.  So again, it seems very clear which of these two companies respects IP and which one does not.

Apple Innovated and Patented their Tech, Google came along and took Apples Tech along with others like MS! MS is also going after Google!  So Google wants Apple to Innovate more so Google can come along and steal even more!  Ya, I see where this is going.

  • http://twitter.com/turkudellinger Misha Dellinger

What can I say. Despite having used an iPhone for about three years now and loving every minute, I’m still rooting for Google and Android on this one. Most consumers probably don’t pay much attention to these things, but in my case this is making Apple look bad. Instead of going to court how about working on new ideas in iOS? iOS5 seems nice enough, but it’s really just playing catch-up. At the moment I’m afraid Android has taken the lead, even if iOS does win with spit and polish.

very interesting comment on the part of mr. schmidt. for those that don’t know,
he is rolling deep with the c.i.a. / n.s.a., so i wouldn’t be terribly surprised if he
gets the court outcome he wants. but to all the retards out there that have no
clue how technology companies run, you defend your intellectual property at
all costs. eric would like you to believe that you just ‘innovate’ out of thin air.
but the fact is, lawsuits are a vital element of business, and exist to serve a
specific purpose. and that is to protect ideas and patents, etc. so quit with
the fantasy world acting where this is good (google) vs. evil (apple). this is
one gargantuan company against another in a competitive battle for alot of
marbles. people have become so disconnected from reality it is ridiculous.

@google-662787d5cc2a489e06b2e8733587bbb6:disqus Pull Gmail connectivity? lol what? . . . And leave all those millions of iOS users to switch to another service?. . . lol what are you saying man? That would only affect Google Users would never happen.

  • Soldierjim

cant wait to try the 4G iPhone, oops there’s not one. Burn in hell Steve Jobs. The ipod touch just like an iPhone that can’t make phone calls, oh then it is just like an iPhone.

  • Scottnj

If Apple didnt come along and change the mobile phone we would still have the crap like the htc tilt and microsoft mobile 6.3
There would be no google android phone, and sure enough a frenzy of all manufacturers trying to catch up.
They all screwed us over the years with junk.
And this coming from someone that would never buy an apple product.

I think most of you forgot what the smart phone was before apple, maybe most of you are to young to know.
