Microsoft hit with lawsuit over Windows Phone ‘Really’ ads

A company called Cellrderm has taken Microsoft to court over its Windows Phone “Really” advertisements, according to Adweek. Cellrderm, a gag company that creates commercials for a fake Cellrderm “cell abuse aid” product, argues that it owns the copyrights to the creative content used in Microsoft’s ads and that Microsoft copied its work in its “Bedroom” and “Bathroom” commercials. You’ve probably seen the ads on TV: in one, a man is too busy on his phone to pay attention to his wife in the bedroom. In another, an executive drops his phone in the urinal and reaches to pick it up. “The Microsoft commercials copy both the sequence of events and the character interplay found in the Cellrderm commercials,” the company wrote in the lawsuit, which was filed in the U.S. District Court for the Southern District of Florida. “The Microsoft commercials also copy other copyrightable expression, including but not limited to clothing, gestures, character appearance, camera angles, and other visual elements from the Cellrderm Commercials.” Cellrderm is seeking damages and has asked the court to block Microsoft from airing the commercials.

    Did Microsoft sue Apple for Mac vs PC commercials? Nope, I know they are suing everybody just much as Apple and everybody else, but this is getting old.

    cmon, i just hate how people sue companies for something that happened a long time ago. You should have sued them at the moment they were supposedly coping your product service, etc. Now they want them to stop airing the aids? You didn’t have to ask them, they stopped airing them a long time ago…..

    Not anywhere close enough in my book. The original commercials struggled
    to get to the point and were done extremely sloppily even for a $0
    budget. To me, those commercials make a statement about the attitude and
    work ethic of the owners of “Cellrderm”. I’m not saying that it’s right
    for larger companies to steal the ideas of smaller ones who can’t
    compete, but clearly Cellrderm COULD have competed better and they’re
    not even for the same product anyway.

    I smell a toss out
    decision. No settlement at all. In fact Microsoft should counter-sue for
    libel. Microsoft can come up with better ideas on their own and they
    did.

      You are clueless. Go and read up why microsoft invested in apple and the conditions under which it happened. it was never a “cant beat ‘em join ‘em case”.
      Back to the point, microsoft should have fired their ad agency the moment they produced thoose appalling ads.

    the cellrdum commercials are dumb and annoying and no one has even heard of them until now and their commercials are only on the internet cause if they were on tv people would change the change. the wp7 commercials are different they use different people and different phones and the wp7 commercials are not annoying so there for cellrdum the company is full of f#cking retards have they watch their own commercials i believe not cause they will see how retarded they are, they are only sueing so people finally notice them cause there stupid product is not selling cause people turn off or close their commercials before 30 second hit hey retards get a clue make them less annoying and people might watch them all the way.
