Secret Service investigates Apple Store spy camera artist [video]

Brooklyn-based artist Kyle McDonald finds himself in hot water after secretly photographing Apple Store customers while they shopping for computers. “I thought maybe we could see ourselves doing this we would think more about our computers and how we’re using them,” McDonald told Mashable. Without the staff’s knowledge, the 25-year-old installed software on computers at two Apple Store locations in New York that used their integrated webcams to capture photos every 60 seconds. The software then automatically sent the photos to McDonald. The electronic artist published his project on his site and a dedicated Tumblr blog, and eyebrows were raised soon after. Mashable reports that McDonald was soon approached by the U.S. Secret Service, and his personal computers have been confiscated as part of the investigation into alleged computer fraud. McDonald says he did get Apple Store security guards’ permission to take photos in the stores, and he also asked permission while photographing patrons — with his handheld camera. McDonald makes no mention of gaining Apple’s permission to install software on display computers that secretly snaps photos and sends them to McDonald behind the scenes.     I think it’s actually a neat project, however the ramifications are clear. All of these people being photographed would more than likely have had agreed to this to be “legal.” I doubt the artist got permission from all of the “thousands” photographed.

      Taking somebody’s photo does not require their consent, nor do you require their consent to publish it. If you do not have them sign a waiver, they can sue you for profits (this is what movies do when they film live, as rare as that is now). The only illegal thing this person may have done is making use of the computers in the store, though I’m not sure how this is illegal.

    I’m going to take a wild guess here and say that all Apple stores follow the same policies and procedures around setting up equipment in their stores.  Suffice to say, what this gentleman  did is probably easily replicable in most Apple stores, if not all of them. 

    Nice to see Apple still takes security seriously.

      Oh lets just say for a moment that instead of spy cam software this guy installed a key logger.  Now, when someone is demoing the equipment they decide to –oh i don’t know– login to their email for example … do you see where the problem is now?  It’s not just about pictures. Two things immediately come to light reading this piece. First, Apple fail from a privacy standpoint, and secondly and more importantly, this guy things the risk was worth the reward. He just got burned and now claims ignorance. Basically he’s a tool.

        This is a stupid argument.  It’s like saying to a car thief that he is being investigated by the Secret Service because it *could* have been a Space Shuttle he stole even though it was actually a car. And that analogy is only true if you (mistakenly) believe this guy was breaking the law.  He wasn’t.  

        This is misdemeanour mischief (messing with the computers without consent).  Everything else he did (taking the pictures and publishing them on the web) is 100% legal.

    This is a ridiculous use of the Secret Service. I don’t think he actually broke the law. Even IF he hadn’t received permission. Calling his actions computer fraud is an absolutely hilarious stretching of the law. There was no fraud. If this was a private residence, they could at least make an invasion of privacy argument, but not in an actual store.

    I’m not saying what he did was right, or even specifically legal, I’m only saying that what he did is probably not illegal and calling out the freaking Secret Service is a waste of resources.

    For one, there’s zero expectation of privacy in a public store. On public/demo PCs, at that. The feds shouldn’t be involved in this, Apple, however, should be. I’m sure the only surveillance they’d allow in their stores would be their own.

    If I take a video of Central Park, and I capture 10 or so people’s faces while doing it, then post that video to the web to say “here’s my Central Park trip” … do I need to obtain the permission of those 10-ish people to do so?
