Apple seeks preliminary injunction to halt sale of four Samsung devices

Apple on Friday asked the U.S District Court in San Jose to issue a preliminary injunction that would halt the sale of four Samsung devices in the U.S. In its filing, Apple has asked the court to halt U.S. sales of Samsung’s Galaxy Tab 10.1, Infuse 4G, DROID Charge and Nexus S 4G, alleging that the devices copy Apple’s mobile products and make use of its patents and intellectual property without authorization. Specifically, Apple claims the devices collectively infringe on three of its design patents and one utility patent. “The message that Samsung conveys to consumers with its imitative smartphone design is simple: ‘It’s just like an iPhone.’ Samsung’s Galaxy 10.1 tablet sends a similar message: ‘It’s just like an iPad,’” Apple wrote in the filing. ” With the benefit of those messages, Samsung is seeking to take market share by trading off of the popularity of Apple’s products.” The move by Apple is the latest in a series of patent-related complaints Apple and Samsung have filed against each other in the U.S. and abroad over.

    I hate this because in today’s business environment, when you can’t compete, you sue. This kind of behavior indicates to me that Apple doesn’t think it can compete on the level that it previously did.

    Moreover, the patents that they’ve added are just unbelievably stupid. A design patent on… lists that scroll. Really? That deserves a patent? My god, the patent system is fucked.

    And the others are design patents. Is Samsung inspired by Apple, maybe even copying them, probably. But do these things pass “the idiot in a hurry” test? I.e., would anyone ever mistake these products as Apple products? In my opinion, they pass this test just fine. I would never be confused, and being “just like an iPad” is very different from saying it IS an iPad.

    While in a world of common sense, these arguments would be laughed out of the courtroom, in today’s patent and copyright thicket, this kind of shit might actually fly. It’s very depressing.

    A few hundred fanboys on both sides doing nothing but bla bla this is better, bla bla that is better.

    It’s business. If you build product X and you get supplier Y to build parts for it, you draw up documents that state that they cannot copy the design.  If supplier Y does take the the designs and puts them into their own product to sell as a competitor, then this is an infringement of the legal documents.

    Let the lawyers handle it, instead of whining about upgrade, android, iOS, owwie my panties are in a bunch.

    You bet your butt that if the shoes were on the other feet, the same exact thing would happen the other way around.  It’s business and it’s how it’s always been and always will be.  No matter what the product, company or cost.

    Interesting that Apple is taking Samsung to court. As I recall, Microsoft has copy ideas from Apple and they did nothing.  I guess, Apple is just like Microsoft in these aspect.  Make great products at ridiculous prices and then tie up the court system when another company creates something more accessable to the masses.

    Kind of like Apple ripping off Android notifications? Apple can steal from Android but when Apple does it they say its magical!
