Apple, RIM, others win Nortel patents at auction

Business

A group of companies including Apple, Microsoft, Research In Motion, Sony, EMC and Ericsson offered the winning bid in an auction that will net them Nortel’s extensive portfolio of patents. The bankrupt telecommunications company held roughly 6,000 patents, and the six-company consortium’s winning bid came in at $4.5 billion. Among the big losers were Google, which opened the bidding at $900 million, and Intel. Patents within the massive cache cover a wide range of technologies including wireless, voice, networking, optical data transmission and 4G LTE. RIM said it would be responsible for $77o million of the winning bid, and Ericsson separately stated it would pay $340 million. The rest of the companies in the consortium did not disclose their contributions.

Will they sue each other over the patents they all share now, just to have something to do?

    • http://twitter.com/BBmundy patrick m lyle

      bahahaha….probably!

  • Brian

I can’t believe BGR. Doing little things to prove how biased they are against RIM. Changing the zero in 770 to an “o”? It’s small but they is no way that is an accident. That is one of the many attacks that they do on RIM on a daily basis just to get page views and show their bias against BlackBerry. Just shameful. Here is the quote “RIM said it would be responsible for $77o million of the winning bid”

    • Anonymous

Look at your keyboard. Look at how close “o” and “0″ are. Then realize that there is no one at BGR making sure that the grammar is correct, or that typos are fixed.

If you think BGR has a hate hard-on for RIM, you’re going to have to do a lot better than this.

    • Anonymous

Ur a fucken moron. So is your typo of they instead of that an accident or on purpose? How does it show bias? Is it lowering the amount? All of a sudden we are sappose to think it’s 77 million? That’s a stretch buddy. U might wanna take the tinfoil hat off your head.  true story™©®

Exactly.  While following that they listed a smaller number of $340 million.  Are we suppose to be tricked by the “o” and think RIM won patents with only $77 million while it clearly states Google started the bidding with $900 million AND was a loser.  Some people are real idiots.

      • Anonymous

Another thing I’d like to point out. The consortium is 6 companies yet in
the title they only mention two. RIM being one of the two. RIM is only in
for 1/6th of the 4.5 billion yet they get mentioned? They talk about google
an the 900 million because that is the only info about the patents (opening
bids) that anyone really knew of. Seriously. U Have seen too many conspiracy
        movies. True story™©®

      • http://pulse.yahoo.com/_JNKVTT7PJMXPYP2GVCIERBQQCU Andrew

Agreed.  You know when a company is in trouble when it’s supporters are paranoid about an “o” instead of an “0″.  That’s just as petty as RIM responding to that letter yesterday.

      • Brian

I’m just pointing out that the corporate culture at BGR, they are just extremely biased against RIM. If you don’t agree with that then you must agree that they at the very least simply don’t like them. But I’ve noticed that among the writers at BGR, they probably get a kick at screwing with any sort of RIM “news” that they hear. So i stand by my earlier statement saying that this was intentional and probably the writer got a laugh at screwing with some more RIM news.

I don’t care whether they like them or not.  I only come for the tech news and not any biased opinions towards anything.  There’s nothing said on this site that makes be want to buy/not buy or like/dislike anything.  So I don’t take it that serious.  Did you miss the article a couple weeks ago with Geller written out a long post about how RIM was his first love and the reason this site was started?  I believe that was true.  But I also believe a lot of people are jaded towards RIM as well.  But I’m certainly not going to get upset over every little thing.  Dude, what others say or mistype isn’t that serious.

You should be complaining to RIM for being so stagnant for it to get to this point where they are the butt of all jokes.  That’s RIM fault. It’s not BGR’s fault that RIM hasn’t done anything exciting in a long time.  BGR didn’t create the Storm or Torch.  He wasn’t working on a tablet when he should have been worknig on phones.  He didn’t release the playbook without the one thing everyone knows blackberry for….EMAIL.  He didn’t ignore iOS and Android for years.  He isn’t planning on releasing a “buy us some more time OS update” i.e. OS 7 aka OS 6.1 and then follow up with QNX not too long after. RIM did this to itself.  The best way to counter this is to actually release products on time and answer the critic with your products not with auto-email responses touting your declining quarterly numbers.  RIM did this.  Not BGR.  And don’t get me wrong, I don’t agree with everything BGR says but I blame RIM for the negative press.  People are just writing about it.  And the people that don’t write about it aren’t doing so because it’s not relevant enough for them.

Dude, the *public* is biased against RIM. Are you really that delusional that you can’t see that?

  • http://twitter.com/BBmundy patrick m lyle

In a time where BlackBerry and Microsoft BADLY need to do something with their Mobile Phones to appeal more to consumers this is a great step forward!  I just hope the patents (“wireless, voice, networking, optical data transmission and 4G LTE”) will be used in an effort to better the technologies that these companies already employ…..but that is a very hopeful thought.

    • http://www.facebook.com/marlon.marlon Marlon

A good chunk of these patents will just be used to troll. I mean, they formed a consortium.  When do you ever see those companies play well together?  They called each other up and said let’s screw X company together.

      • http://twitter.com/_Markaveli Mr. Marley Jones

No, they will be used for protection (hence, the Kodak lawsuit that RIM and Apple are just now getting over and the pending Dolby lawsuit against RIM).

      • http://pulse.yahoo.com/_JNKVTT7PJMXPYP2GVCIERBQQCU Andrew

Yeah but the many of those patents won’t be used by the company that owns them now.  They just like to own the rights so they can sue if someone else uses it.  I personally think if a company has a patent on something and is not actually using it or in the process of utilizing it they should have to give it up so another company will actually make some good use out of it.

Pretty much, Google is running crazy in the market right now gobbling up too much space. MS wants to slow Android down, Apple told these guys that they are a working their High end Market and they are happy there and RIM is just trying to stay above water and slowing Android down is needed. So what better way then to screw Google. Google is in a real bind now. MS is going to tear them a new whole. Patent law needs to be updated because this is getting ridiculous.

      • http://pulse.yahoo.com/_JNKVTT7PJMXPYP2GVCIERBQQCU Andrew

Fully agree.  You’d think Google would drop some major cash with the way they are being sued.  You give the rights to some major patents to companies like RIM, MS and Apple and you have none, that’s going to be some trouble down the line.  Of course all it will lead to is settlements but nonetheless that’s cash out of their pocket.  I am a little stunned they weren’t more active.

      • Tom in Toronto

They got together to cover their respective butts and to keep the portfolio away from Google.

This makes me wonder how committed Google really is to Android.  I mean they are getting sued like crazy and own almost 0 important patents. You’d think they’d be a major player in this auction.  They have more than enough cash to win some of the patents given the amounts RIM and Ericsson bid.  And people talking about Apple not being innovative.  Google uses everyone else technology and appears they don’t care and aren’t interested in actually owning the rights to somethings that add to Android.  Just makes me wonder.

    • Anonymous

Google bid $900mm. RIM and SE are in a $4.5B bid…

      • Anonymous

U understand that 900m is an initial bid. This was an auction. Highest bidder wins. However google probably looked at the 6 companies, and with Microsoft and apple each alone having more money than google, decided not to bid higher than 4.5 billion. True story™©®

  • Anonymous

Google had more than enough cash to win this auction and are the big losers in this bid.  Something tells me they are not putting their hearts into Android.  This auction, combined with their deafening silence on the Lodsys cases, shows that they’re putting their efforts elsewhere: search and Google+.

    • http://pulse.yahoo.com/_JNKVTT7PJMXPYP2GVCIERBQQCU Andrew

Seems that way.   I wonder how much money they actually make from Android.  I know there were things written awhile ago that said they didn’t make anything on the actually OS but from licensing their apps and advertising.  So it actually costs them money for development and not to mention they are being sued crazy.  And Android just really furthers their already massive ad and licensing monster.

      • Anonymous

The purpose of Android was and still is to make sure Google’s services, including it’s search, are as ubiquitous on mobile devices as they are on PCs.

The app model (using native apps instead of the web) could end up circumventing Google’s search-based ad revenue, so Google needed to stem the tide of iOS. They succeeded so far, so now they can turn their attention to making money off the infrastructure (read: you and your phone) they just created.

  • http://twitter.com/Project__K CJB

I am pretty certain Google weighed its options here. Sure, they have the cash to have won this auction. I think the following points are what Google considered.

Winning would result in no longer having to pay present/future royalties and provide protection in patent litigation. But, attempting to win would put Google in the middle of a bidding war with the sale potentially erupting into a multi-billion dollar purchase.

Losing would see no major change to Google’s balance sheet bottom line. The status quo could be kept in tact. The company is already paying license fees to patent holders. I think Google asked would purchasing this portfolio truly benefit our future goals?

Google is also assuming ‘The New Alliance’ will not go on a patent offensive and seek to increase royalties or target specific companies with legal action. A scenario I and Google see as highly unlikely given the major member of the alliance in Microsoft.
All in all…Google sees the “wash”. This auction adds more fuel to the fire of how badly broken our patent system is.

    • http://pulse.yahoo.com/_JNKVTT7PJMXPYP2GVCIERBQQCU Andrew

It won’t be a wash when they continue to get sued all over the placed.  Now that MS owns some of this stuff, they will have no problem suing anyone.  At the end of the day, it’s cheaper to own it than license it and pay settlement fees for the ones you don’t license.

I was a big BGR fan but seeing their bias over RIM over the last couple of months, I am starting to hate the site.Everything they show about the company is NEGATIVE. Being a tech geek, I love technology and all related companies that bring innovation from google to apple, rim to intel. This is not good journalism.  Starting to look for other good tech blogs like engadget, any suggestions for good tech blogs?

All of you who don’t believe there is a lot of negativity against RIM, you must remember that in the recent past anything that the company does (good or bad) is welcomed by negative sentiments. Surely, BGR execs are against RIM because it is a Canadian company. They are trying so hard to make sure that the company loses market share in North America.  Overall, RIM has weathered the recession quite well, but I noticed that any time the company misses a little bit of analysts’ expectations its share value drops by so much. However, whenever the company beats analysts’ expectations, there isn’t much momentum built on its good performance.  If you don’t agree with all this, then you must be sick in your brain, and need some brain surgery.

Whos responsible for all this mess? Is it the competitors or those analysts who are RIM short sellers?

WebOS is dead officially at this point.

If you have a long term mobile strategy, then you joined the grand alliance to buy a piece of the Nortel patents to fight against Google.

HP is nowhere to be found on this deal.

Apple has rallied the anti android troops together. Google is finished. They will lose BILLIONS to oracle for flat out stealing their code. Now they have no defense for their 4G phones. It’s over people. Google will abandon android in the next year or two. It would be wise to switch to Apple while u can.  true story™©®
