Judge denies Samsung access to unreleased iPad, iPhone

According to FOSS Patents, a judge in the U.S. District Court in the Northern District of California has ruled that Samsung cannot view Apple’s next-generation iPad and iPhone products. The whole debacle started when Apple began accusing Samsung of creating copycat products — as such, it asked the Korean firm to produce its next-generation devices inside a court room. The court took Apple’s side and Samsung was forced to show Apple the Galaxy S II, Galaxy Tab 8.9, Galaxy Tab 10.1, Infuse 4G, and DROID Charge. In an effort to prepare for further legal battles with Apple, Samsung wanted the same access to Apple’s next generation products. For now, that won’t happen. The reasoning behind the judge’s decision appears to be that Samsung had already showed off its products to members of the press and others. Apple, as usual, has kept its products close to the vest.

       Could somebody inform me why Apple is wasting tax dollars on demanding to see products that are already available to the public?  This country needs to start charging steep court fees for corporate litigation to deter needless lawsuits.

The galaxy s 2 rapes the iPhone 4 and as we all know apple just make minor upgrades each year and claim it to be “innovating and radical” and I can already tell that all these high end android devices will still rape the iPhone 5 and the galaxy s 2 is the top android device out right now.

        Most of the Android people on here are brainless snobs that march to anything Android. If it is Apple related, they mindlessly bash it. All drones. Same can be said for a lot of iPhone fanboys though. The funny thing is … lots of people here somehow think they are right and everyone else is wrong. They love Android, so if you happen to love iPhone you must be drinking the kool aid. BUT, if you love Android you are somehow correct. It’s quite pathetic. I love iPhone and Android. I rock my Inspire 4G and think it is far superior. But I also recognize that there are flaws to it that iPhone got right and vice versa. Neither is the end all be all smartphone.

        Joao, Did you attempt to read what the Judge said and her reasoning for it? 

        It isn’t about giving anyone an advantage. It’s the fact that Apple requested for products already announced and launching imminently if not already launched, products that are competing, will compete with the iPhone 4 / iPad 2 (Which also bears resemblence to the iPhone / iPad released to date). The Product that Apple Claims Samsung has copied is up to the iPhone 4 / iPad 2. Thus, the suit does not touch on the next generations iPhones or iPads, therefore there is no need or requirement for Apple to be showing their Next Gen Products.

        What part don’t you get? The devices are all ready out on the open. If Samsung did not announce them, apple would have bot been allowed to view the product. And if apple had announce the new iPhone at WWDC then Samsung would would have been allowed to view the device.
        Apple does get advantages, but not in this case.

        You might have a point if Samsung hadn’t made it a point to parade all of the aforementioned products in the press, give all the tech specs, etc. When BGR posted the article about Apple getting access to Samsung’s hardware, I remember being surprised because it seemed like all of it was basically available in stores by that time.

        Apple, on the other hand, will straight up try to ruin your life if you get a hold of their hardware before they’re prepared to release it. See: the clusterfuck between Gizmodo and Apple during the iPhone 4 situation.

        Did this ruling say anything about Apple granted access to future Samsung products? I think NOT! All Samsung had to show were products they already showed in public. So cool down and read closely before whining on behalf of the company who got their design from Cupertino and the OS from Mountain View.

      Android was in deveolpement far earlier then apples i.o.s was. Also who cares who copies who apple has copied android and so has every other company each other. Smart phone platforms were not created by apple nor android all they did was change it. So in all honesty apple did not come up with the smart phone idea… Know your facts before you speak, smart phones were out since 1991 they were a lil different but alas it was around. The only way apple wins is cuse of their patent portfolio, jobs whines to much that people are stealing “HIS” idea when it was never his to begin with. Funny thing is though you never hear google throw a fit over apple or anyone else taking what they designed, furthermore, technology was ment to be open sourced not closed didnt apple think that same way years ago?…

    I am probably reading this wrong but the judge is siding with Apple because they keep their products under wraps correct?  If that’s the case then how the hell is any competitor supposed to know exactly what an Apple device is going to look like other than patent applications and FCC reports (which are shit to begin with)?

    Is the judge saying ” Samsung….make sure you are not creating devices that look like what could possibly be a future Apple product even though you have no clue what it is going to look like.”?  If that is the case this judge is a lunatic and if they are saying that Apple should be allowed to say what does and doesn’t look like the product they have under wraps and whether or not they are going to sue then he is even more of an idiot.

      Not quite– the judge is saying, “based on your past Samsung, you continuously copied existing Apple products.  We’re checking your next batch to see if you stopped or not.”  Future products that haven’t been unveiled don’t matter and would constitute a whole new argument.  Samsung has directly copied Apple, and Apple wants to make sure they stop– what’s the harm in that?

        So the comparison of what Apple gets to see vs what Samsung wants to see is Apples (pun intended) and Oranges?  That to me is what makes no sense.  The argument of “close to the vest” makes zero sense if the argument is future products vs. current products.  The judge should be saying I need to see the Apple devices that they claim are being copied by Samsung and I need to see the Samsung devices that are copies of CURRENT Apple products. 

        The whole part about seeing future Apple products should have been thrown out on irrelevance not the “close to the vest” argument.

      From what I have read the products that apple is asking to see are items that have either shipped or have been given to certain developers for testing etc. Samsung is asking to see future un announced products from apple. True story™©®

    Seriously?  Don’t get me wrong, I’m all for companies protecting their IP, but when you have one side that gets to see the others by court order, it’s only fair to make the other side play game.  I’m no lawyer, but the whole “they’re more secretive than you are” excuse doesn’t even remotely sound like a legal defense.

    So, let me get his straight. The judge wasted tax payers money even though the products Apple wanted to see had already been seen by the “press and others”? Everyone who reads a tech blog saw the requested products months ago but Apple’s lawyers needed a special judgement from a judge to see them in person. Nice.

    How to do you write such crap? This site sucks man I am done. The court ruled that outside counsel see’s Sammy’s products, not Apple or the Apple’s lawyers. Sammy wanted to see Apple’s products how is that the same thing? If Sammy said let the same third party see them ok that would be the same thing.

    From what I have read the products that apple is asking to see are items that have either shipped or have been given to certain developers. @Amanda, I paid $32.67 for a XBOX 360 and my mom got a 17 inch Toshiba laptop for $94.83 being delivered to our house tomorrow by FedEX. I will never again pay expensive retail prices at stores. I even sold a 46 inch HDTV to my boss for $650 and it only cost me $52.78 to get.     Oh who CARES?! Products are forever copying each other. If one design works, then obviously other companies are wanting to follow market trend and try and tweak it to sell some of their own. What a waste of money arguing something that’s bound to happen anyway.
