Nokia reloads, files new suit against Apple with ITC

Legal

If at first you don’t succeed, try, try again. That’s the adage we remember from our youth, and that’s the attitude Nokia is taking when it comes to Apple, its patents, and the International Trade Commission (ITC). Just last Friday, an ITC judge ruled that Apple, Inc. did not infringe upon five patents held by Finnish mobile giant Nokia. Unsatisfied with and undeterred by the outcome, Nokia has regrouped and refiled suit against the Cupertino company, claiming infringement on seven patents related to “multi-tasking operating systems, data synchronization, positioning, call quality and the use of Bluetooth accessories.”

“Our latest ITC filing means we now have 46 Nokia patents in suit against Apple, many filed more than 10 years before Apple made its first iPhone,” said Paul Melin, Nokia’s vice president of intellectual property.

Now that’s something to be proud of… right? Nokia and Apple also have court cases pending in Britain, Germany, the Netherlands, and the United States.

      I bet u tyoed that out using ur iPhone.
      Nokia have been making a few of the BEST phones in the market. just coz u paid a lot of $$$ for ur shiny, new Apple product,u think it’s the best. Lemme see how an iPhone stands up to an Android.

        A pointless reply since Nokia doesn’t make android phones. Nevertheless my iPhone 4 holds up quite nicely vs either android or whatever outdated junk Nokia is shipping today, thank you very much.

        Hey, how’s that 0.30 Pixel Front Facing Camera?

      • edoug

        Hey Papinyc, that front camera is great, thanks for asking!

      • Anonymous

        Yep. I use it for facetime and maybe the occasional facebook self-pic. Works just fine, thanks. The rear camera on the other hand. Well let’s just say I haven’t touched my point and shoot camera for almost a year now.

        What did you use??? WP7? Android? Pen and paper???

        Whatever it was, it’s embarrassing to know you are a wannabe Goofan (aka Apple Hater!)

        “I bet u tyoed that out using ur iPhone”

        If you tyoed [sic] it from your Android , you’re not making a strong case for preferred product…

    So I guess my question is why weren’t these additional patents part of the initial complaint?

  • WTF

    Why doesn’t apple just buy nokia already. Every time you turn around nokia is trying to sue someone. If they spent some if that time figuring out why their phones suck they might get somewhere. Nokia was cool back in the 90′s.

      I think MS has dibs.

  • desperatefinlands

    Why just apple ?

    • Anonymous

      Probably because Apple’s sitting on a pile of cash that would make Scrooge McDuck weep.

      • desperatefinlands

        I mean those ‘patents’ are used almost by every manufacturer, why not sue more companies, suing more companies = more money . Is there a personal vendetta between finlands and steve ?

        Why not sue Nokia for suing others while you at it. LOL! Damn Nokia! This is all about Nokia making stupid phones and blame others for making better phones.

    Nokia and Microsoft announce they are working together on Windows phones ( ho hum ). Nokia sues Apple. Anyone surprised?

    • Anonymous

      Actually Nokia sued Apple before that deal. I think Apple and Microsoft are playing nicely together these days. I think the new case includes Nokia suing Apple for Multitasking. Considering Apple’s based on Unix that is going to be some stretch from Nokia claiming to have patented that.

      I think Nokia are trying to have their cake and eat it. The initial argument was that they were using some of their patents in the iPhone comms stuff. The problem is that this comms stuff was part of the standard. Not being a lawyer I don’t think it is a great idea to create a standard and then sue everyone who uses that standard. That’s not what standards are for.

      • Msknutson

        Correct! IIRC, Microsoft is still Apple’s biggest development partner by far. With all this litigation, only the lawyers win, and the consumer loses. Rather than the constant lawsuits, simply build a better product!

  • Gaza

    Wait… No “It is disgusting when these companies sue each other over nonsense…” statements? OH! It’s Apple being sued. Well, it’s okay if this is the case. Carry on…

    • http://twitter.com/atlharry Harold Min

      Of course, how can you really feel sorry for Apple when they sue for things like the gesture used to unlock a phone?

  • Chut Pata

    It is not an adage. It is a classic poem by famous English poet Robert Browning:

    ‘Tis a lesson you should heed,
    Try, try again;
    If at first you don’t succeed,
    Try, try again;
    Then your courage should appear,
    For, if you will persevere,
    You will conquer, never fear;
    Try, try again.

    Once or twice though you should fail,
    Try, try again;
    If you would at last prevail,
    Try, try again;
    If we strive, ’tis no disgrace
    Though we do not win the race;
    What should you do in the case?
    Try, try again.

    Time will bring you your reward,
    Try, try again.
    All that other folks can do,
    Why, with patience, should not you?
    Only keep this rule in view;
    Try, try again.

      My GOD this site is edjumakashunal’!!!

      Who knew, thanks Chuta. Why can’t Steve Jobs try, try again not to be an ¡D¡ck?

      Footnote: it was also a hit song in 2000; Aaliyah, “Try Again”.

      • edoug

        Good question papinyc, why do you think?

  • xxdesmus

    Shocking

    – Apple sues someone then it’s totally understandable and shameful that another company is “stealing” their work.

    – Another company sues Apple for shamefully stealing their patented technology and suddenly that company is the bad guy.

    Carry on fanboys, as you were.

    Way yo compete on the merits of your products, Nokia. Software patent-based lawsuits are pathetic and it’s sad to see Nokia behaving this way. Oracle? You expect this from them, but Nokia was once a great company.

  • Catroll

    Nokia filing a lawsuit against Apple is more like the UN sanctioning airstrikes against Moammar Qaddafi, as that is what Apple has become, killing innovation, choice just as much as he kills civilians.

  • Anonymous

    Apple should counter sue Nokia.

  • Anonymous

    What’s next? Infringing by having images on a display patent?

    • http://twitter.com/atlharry Harold Min

      I believe Apple has already sued someone for that.
