Judge orders Time Warner to out illegal downloaders

Time Warner has been ordered by a U.S. District Court judge in Washington to identify hundreds of people accused of illegally downloading movies over its broadband network. The ISP had previously argued that identifying the accused parties would be “unfairly expensive and time-consuming,” and it asked that the judge reject the subpoenas for subscriber information. Of the three pending cases where subpoenas for subscriber data were issued, the judge agreed to quash one, as the plaintiff, Maverick Entertainment Group, failed to properly serve the subpoena in compliance with the law. The other two stand, however, and Time Warner will have to identify approximately 250 subscribers. Maverick, one of three movie companies currently seeking the identities of anonymous Internet users who are accused of illegally downloading their copyrighted materials, has 10 days to re-issue the subpoena or it may lose access to the identities of over 700 users.

        Er … yes but at the same time nobody would really consider downloading illegal materials as a personal freedom or liberty. I meant that the judge is bringing on a lot more work than courts can handle, and is playing the role of a prosecutor which is. Bad bad bad … of course, if the plaintiffs moved for forced discovery then the judge isn’t just ordering stuff up out of nowhere. That’s what I think is happening … but won’t it be interesting when his or her relatives show up as an illegal downloader?

    Hollywood cracks me up. Keep in mind that I don’t pirate movies, but check this out.

    In the last couple of years, Hollywood has cranked out a handfull of blockbusters (i.e. “Toy Story 3″, “The Dark Knight”, “Inception”, “Avatar”, “The King’s Speech”, etc.). This tells me that people aren’t unwilling to pay to see movies, they just want to see something that they would deem “good”. Yet, 90% of the films Hollywood churns out are garbage, and people are finally tired of wasting their money.

    Where I work, if I don’t do my job (and do it well), then they’ll fire me. However, movie studios expect to get paid, even when 90% of the movies they generate are barely-written drivel.

    I think the Amish have the right idea.

      No you have the wrong idea. They created the work and do deem to get paid. Just as you expect to get paid just for walking in the door at work. The same applies. And taking your job and the movie industry and trying to compare the two are not even going to work. Hollywood spends MILLIONS to create movies and hopes to make a profit off of what they created. YOU are not spending that kind of money when you walk in to your job.

      If you think the Amish have the right idea you need to go see how they live now. More than 80% of them don’t even farm their own land. They work for Corp. America in factories and such. Go take a look at their farms.

        I don’t expect to get paid for walking in the door at my job. If I were to, one day, walk in the door and just stand there, I would expect zero compensation. I would expect to get fired for not being at my desk working. I expect to get paid when I work.

        Also, I don’t care how much Hollywood spends on their movies. They’re usually over-produced, explosion-laden garbage with one-dimensional characters with no plot. I would think that if they put that much money into something, they would want to make a quality production.

        In other words, I don’t care how much they spend on making movies — if it sucks, I’m not going to pay to watch it. It’s similar to: if my job performance sucks, my boss isn’t going to pay for me to be there.

        And my Amish quote was sarcasm. Grow a sense of humor.

        No, you’re right. These companies do deserve compensation for you having made a product and me partaking in it. That being said, for me and my girlfriend to watch a movie at the theater, it’s nearly $20.00. I, personally, am not comfortable spending that kind of money for a sub-par quality product.

        If there was a way to pay less to watch a movie that was garbage, that would be fine. As it is, I can’t blame people for pirating.

        Only $20 for two people to see a movie! In Australia it costs $36 for two people….this is just for the ticket, before popcorn and drinks etc.
        I agree. If I am going to pay $36 for a movie, it is going to want to be bloody good. Most of the time, it is utter crap. If I pirate a movie that is a gem, then I will buy the DVD/BR.
        Happy to pay for a movie, but if I do, I want to get my money’s worth!!!!

      So movie makers get to make crap that I HAVE to pay for just to get in and they get my money no matter how much it annoys the crap out of me? No thanks. Anybody can make a movie trailer look good, and usually it’s false advertising. There have been movies that had trailers totally misleading the public. There’s no way I am going to pay for the amount of suck that comes out of Hollywood, but do I want to check it out to see if it’s worth the money? Sure. But I’m not going to spend the money on gas, then pay 12$ to a company that pumps out garbage, just to find out it sucked and I’ve wasted my time on a boring horrible film and spent time in traffic to get home upset and feeling ripped off. I don’t go to the theaters anymore, I used to download them but now they aren’t even worth downloading. Most movies are garbage and a complete waste of life. Definitely not worth the risk of going to jail over the same movie with different actors.

      I don’t blame people for pirating movies, and I especially don’t blame people for pirating music.

      But if you want to make money on a movie, try making it amazing and good instead of throwing out some crap that anybody could write or make without all of the expensive cameras and get the same result. Maybe you wouldn’t have to worry about piracy. Maybe you wouldn’t be wasting money on prosecuting people over downloading an even worse quality version of your garbage. If you made something amazing, that interests people you’d just laugh with all your millions you made.

      If anybody should be prosecuted it should be Hollywood for forcing people to pay for garbage just to find out if they like it. I’d like a try before you pay system in place here, (trailers usually don’t cut it) or these people shouldn’t even be going to court. What crime is it for trying something before you buy it? You can test drive a car, you can try out most cellphones for 14 days, most products have guaruntees. The movie industry doesn’t have this because they know if they showed people the real product nobody would want to pay for it anyway. Might as well give it away for free.

      Most albums for music aren’t worth paying for because usually you only like one or two songs, so thank god they made it so you can listen to some of the song before you buy it. I don’t mind paying 1$ for one song I enjoy. Too bad the selection sucks. Just use Pandora like everyone else.

      Sad to see people wasting court time over garbage movies that nobody cared about anyway, and if they did care about them they already made a killing at the box office. Most of the people who download movies can’t afford to go see them so they wouldn’t have made the money anyway. So really they’re just wasting more money on court fees to punish people they wouldn’t have made money off of in the first place. What geniuses they are.

      Aren’t there bigger problems like jobless, homeless, healthcareless, radiation poisoned people to worry about? You want to take someone to court, get the politicians in there. The government is always breaking the law, but nobody is suing them over the stupid crap they do… you want to put some teenagers in jail over some movies? Go to hell.

If you don’t like a sporting event all you have to do is not go, because you know when your team is winning or losing (if that’s how you judge going to sporting events). If you’re a fan of the game then you’re going to go to the event no matter what. If my boss didn’t like the work I did, he makes me do it again, or he’s going to fire me if I keep it up.         fairly easily (at least on my mac): transmission setting “ignore unencrypted peers”

        Most modern torrent feeds prefer encryption.

      And the ISP should have the right to block your ports and start filtering. But by encrypting it won’t do a thing. You download an illegal movie and it ‘calls home” what are you going to do? They still have your IP address when it does that. So what’s the point. You are NOT protected by any laws at all. Next thing that needs to come is start kicking those who commit crimes off their ISP and teach them a lesson; maybe send them to our already over crowded prisons and then hit them with the nice little catch they can’t use or own a computer; no access to the internet; nor own any device that has the internet on it: including cell phones that are beyond any type of basic phone. Maybe doing that for about 3 years will show that their commiting crimes.

    What good is encrypting your torrent going to do? All that needs to be done is for the organization to join the group and harvest IP addresses that way. Encryption means nothing in that regard.

        As far as the movie calling home, I tend to convert any media I download and usually compress it in the process. So I don’t think it’s going to retain the ability to call home. Most of the theatre movie piracy happens in europe, russia and china from what I have seen.

        I fully agree with what that other gentleman stated about so many movies not being worth paying for. I think when you go see a movie that there should be a “money back” guarantee, if you did not enjoy the movie.

        Years ago, I used to work with an older guy that was retired military officer. He had high morals and did not like profane language. He took his wife to see “The Postman Always Rings Twice”. He had read the reviews in the newspaper about it being highly rated. Well after about 30 minutes of watching it and being totally disgusted with the language and content of the movie, they got up and left. He demanded his money back.

        It should be like Best Buy or Walmart, If you don’t like it get a refund. Also the actors should only get paid if its a good performance. I think most actors, if not all, read the preliminary screen play before they agree to :star” in it. So unless they are total idiots, surely they know its a “bust”.

        Also I hope since you agree with this being illegal I certainly hope you do not read any documents or comments that are not “PC” (Politically Correct), Sexist, Demeaning to any minorities. Also include in this any future deemed religious type material that might contain the words God or Jesus. The LAWS change and in the future, you actions might condemn you.

        Oh and don’t try to “hack” my IP, I’m borrowing internet off a long range connection from a free internet linkup.

      Yes because I agree with you – it shouldn’t be illegal.

      No because being affiliated with copyright infringement whatsoever, whether or not you actually own the material, has been considered illegal since well before VHS.

      Also, they could technically argue that during your download of a movie that you may have owned, you illegally uploaded parts of it to at least 100 other people (thanks to the anti-leeching mechanics of BitTorrent), meaning you are at least somewhat responsible for those extra copies. This is where the judges are able to say you may owe “up to $3,000,” like in the one well known music piracy case where the MPAA is unfairly demanding $1.5 million from the defendant, because technically you should have to pay for all those partial copies of the media you served to those 100 other people.

    Ever wonder why movies and music cost the same no matter what the demand? Why do movie houses charge the same for the blockbuster as they do for the dog? It’s called price fixing. The entertainment industry tells the movie houses and the record stores how much to charge. If they do not comply or step out and charge something less in order to increase business then they mysteriously are treated less favorably by the industry. People who work in the industry know this. Movies and music are not milk or gas. Will Congress investigate the industry for fixing prices that is to the consumer’s detriment?

So for one person to be critical of another person for commonly shared practices is why the United States is in the shit hole its in. Some say let them download and some say it’s wrong and they should have to pay.     Hollywood makes a ton of crap, but it really doesn’t make sense to say “I would never pay to watch that”, then turn around and steal it.

    That’s like saying you would never pay to eat pigs feet, then turn around and shoplift a jar of it and eat it.

    I think its horrible the judge wants to know individuals, I think this a ‘problem’ thats between the movie studios, internet providers and P2P providers… pulling in the individuals is bad. You don’t crack down on the users, you crack down on the dealers.

    Although, my argument is always this: These people would NOT PAY to see the movie regardless if you can steal it or not. If anything, one person ‘steals’ a movie, tells another person, “Hey, it’s actually pretty good!” and then that person goes and RENTS the disc and then tells someone else who goes and buys it, etc. Oddly enough, I’ve had that happen from time to time.

    So what happens when American citizens begin to realize that
    A. The movie studios want to arrest people and that
    B. The government forced the ISPs to give up these people?

    So, is the potential amount of loss from the sharing of these movies greater than the loss that would occur from backlash when people refuse to see movies and find alternatives to the ISPs that helps put people in jail or fined insane amount of money?

    The ‘cost of making a movie’ is insane anyway. More reliance on CGI reduces the cost of special fx. Product placement helps pay for the film. How come studios find ways to help pay for the movie, but yet costs continue to rise? Here’s another thought: Some cruddy ‘A list’ actor demands millions for a role, gets paid millions, driving the cost of the film up, then it raises the price of the seats in the theater and they wonder why people are stealing? Then you got a stuntman making PSAs about not getting paid for the work they do? Come on. The bottom line is that Hollywood is full of crooks and they are making BANK everyday, then the studios do their best to screw everyone out of money, make up hundreds of different ‘costs’ that make it seem like they spent a lot more on the film and to make it look like it was harder to make profit.

    No sympathy for this industry. They don’t want people to steal, then start thinking outside the box already. Its a new century and the way these businesses were run is becoming a detriment to themselves, but instead of looking internally for answers, they just want to start scaring consumers with fines and jail time. that’s going to make it worse for them.

    But no excuses for stealing either… stealing is stealing and we all take a chance.

    y cant they just make digital content like 5$ a pop instead of 20$, being the same price as the physical content, if they did this, that would in my mind eliminate the need for having to dl illegally, cuz i wouldnt even think twice about it and could justify spending 5$ on a HQ digital copy. but no, the production companies r trying to sqeeze every dollar out of the consumers, and dont care. just my 2 cents though

I think that Time Warner should have something encoded to make it impossible for movies to be downloaded ilegally..( I’m not a tech so don’t know the correct terminology) but you get my drift.,not punish people that know what they’re doing and can dowload. It’s not their fault..

    I think the copyright owners do that the right to investigate people who might be infringing on their copyrights, BUT… they should pay the cost themselves. IT is expensive for TWC to dedicate all that man power to those lookups. In turn, that cost gets passed down to me. These are civil cases, TWC should be reimbursed for the cost by the plaintiff.
