Oracle files suit, goes after Google over Android's use of Java

Legal

CNET is reporting that software giant Oracle has filed a lawsuit against Google for the search giant’s use of Java in the Android mobile operating system. According to the suit, Google: “knowingly, directly and repeatedly infringed Oracle’s Java-related intellectual property.” Google noted that they had not yet been served with the suit and therefore could not comment. The suit also claims that “Google has been aware of Sun’s patent portfolio, including the patents at issue, since the middle of this decade.” Both companies certainly have enough money to drag this one out for a very, very long time in court. We’ll keep a close watch on the proceedings and report back when any major milestones are reached.

Google only has itself to blame. They will have to pay because they have breached the patents. I don’t even think its that complex. They might as well give up now and avoid share price volatility.

As JohnH says above, if they’d stuck to the GPL’d VM there’d be no case. But they didn’t.

It’s ironic but in a sense Oracle could claim to be protecting Java by ensuring one standard exists (though clearly thats long since not been the case).

I suppose the Oracle suit will at least distract them from the NTP suit that has to be worth a billion for bigger licensees like Apple and Google.

As for the conversation about Nokia vs Apple. This market has been going for 20 years. Long before Apple arrived (btw Nokia had excellent smart phones in the late 90′s). And it will continue long into the future. There’s plenty of room for all.

Consumers change their phones regularly. I change mine once every two years at least and I’m probably more conservative than most.

Given the changes in technology each year, the phone you have now (Apple or whoever) will be out of date next year, and well out of date the year after.

The truth is there is only volume in this game. Apple, Google etc will have to come up with a game changing device every year or two or they become also rans and will have to mark down their products appropriately.
