HTC files patent infringement suit against Apple

What, you didn’t think HTC was going to just sit and twiddle its thumbs while Apple was suing it, did you? Late this afternoon, HTC announced it has filed a lawsuit against Apple alleging the infringement of five of its patents. The specific patents involved in the suit were not divulged, but we do know HTC is asking the ITC to stop the importation and sale of the iPad, iPhone and iPod in the States. HTC’s Jason Mackenzie, had this to say:

As the innovator of the original Windows Mobile PocketPC Phone Edition in 2002 and the first Android smartphone in 2008, HTC believes the industry should be driven by healthy competition and innovation that offer consumers the best, most accessible mobile experiences possible. We are taking this action against Apple to protect our intellectual property, our industry partners, and most importantly our customers that use HTC phones.”

Apple has yet to publicly respond to the lawsuit.

    This is all part of HTC’s defense against the suit Apple filed against them. They will both drop their suits and settle, the only question is who writes the annual royalty check and for how much. Nothing to see here, move along.

    Hard to have an actual dialog all the fanboys of both sides having a pep rally… all flag waving but no game.

    If this suit is like the Nokia suit there is probably licensing issue involved. Nokia wants to charge Apple 3x higher rate than any other maker. Elan maybe has a similar issue, we don’t know yet.

    It’s the ITC’s job to sort through these issues. It isn’t court–it’s quasi-legal, unbinding arbitration.

    REALITY CHECK: The ITC isn’t going to stop sales of an American company in the United States.

      just read the hilarity in this past thread. the fanboys on here were just about to wage a jihad against the itc for allowing apple to file a suit against htc.

      amazing how now that htc is suing apple, the amazing turn around.

      the reality is that both htc and apple can fire syits away as long as they have legitimate patents that they themselves own.

    The simple fact HTC filed this case with the FTC, an admnistrative body, tells me HTC is fairly certain their case won’t hold up under higher standards imposed by the courts. In the end, nothing will come of it.

      That doesn’t guarantee anything. We only know bits and pieces. You know this has to involve their access to the MS patents as part of their new partnership. Catch the line about protecting their industry partners? And who do you think that could be?

      HTC is acting as a proxy for MS now. Nice move.

      The only thing that is certain is Apple will need to stop playing the bully in the playground and learn others can be just as creative and innovate and get credit for it. They can’t just keep going around acting like they reinvented the smartphone.

        M$ already settled and allowed HTC to license some Microsoft’s patents.

        HTC can’t act like a Proxy for M$. If they don’t own the patent. Those patents HTC are claiming infringed upon has to be their very own.

        Look at all of the new OS’. Apple did reinvent the smartphone, smart-one. And, you need to learn that everybody sues, but it’s these sites that like to make Apple’s lawsuits front and center, so stop being a douche.

    despite many people including myself explaining the patent process and that patents are a fact of life. the fandroids ridiculed fair explaining of what was happening. they acted like it was the end of the world.

    now htc has some patents up its sleeve and all of a sudden its happy days are hear again? all of a sudden the patent process shouldn’t be changed? what happened to all the charges levied at the lunatic fandroids (not all androoid users) like there is a conspiracy. what an amazing turn around in attitudes towards patents.

    i said it before and i’ll say it again. companies have patents and they all have the right to protect their patents. htc is exercising the very same right as apple. period

    those that commented reasonably in that past thread are now vindicated.

    The irony of people complaining about the hypocrticial nature of anti-Apple fans is that its just as annoying as the anti-Apple fans and Apple fanboys combined. I imagine you all have heads in the shape of eggs and your daddy was known as Humpty.
