Rogers sues Bell over network claims

The ridiculousness that is Canada’s wireless industry reached unprecedented heights today after Rogers Wireless filed a lawsuit against Bell in B.C. Supreme Court. Rogers is asking that Bell stop touting its new HSPA network as the best thing since sliced bread because “Bell has no valid support to claim faster speed and more reliability on a network that has virtually no customers and no proven track record on this new network.” Principle to Rogers’ argument is that “the vast majority of Bell customers are still using an old CDMA network and aren’t enjoying the benefits of the new HSPA network” and that “reliability is not something that can be measured on an empty, unproven network.” This lawsuit falls exactly one week after a B.C. Supreme Court Justice sided with TELUS in its lawsuit against Rogers which forced the company to stop its ads claiming “Canada’s Most Reliable Network” with speeds “two times faster than any other”. We’ll be sure to keep our readers up to date with the latest information as it becomes available, but we can’t help but think these lawsuits will make consumers hate the Big Three even more than they do now. Anyone else feeling this way? Mr. Ken Campbell, how we lookin’?

    Love it when the old stogy telephone companies feel threatened. When they can’t compete they just sue eachother.

    I’m sure next year when T-Mobile USA launches their HSPA + network both Verizon and AT&T will sue them over similar claims.

    Can’t wait.

    I disagree. The issue is that Bell has hardly any customers on their new network. The vast majority are still on the old network. Existing customers get no benefit from the new technology until they upgrade to phones capable of utilizing it.

      Fine but Bells HSPA+ is way faster Rogers. and the fact that so few are using the Bell HSPA network means you can get a lot closer to the theoretical 21Mbps speed right now than you would be able to on Rogers’ heavily used GSM bandwidth which only has a theoretical speed of 7.2Mbps anyway.
      Besides, the ads arent for existing customers, its to attract new ones, and Bell now offers a load of new GSM phones that are pretty decent and able to make use of the super fast network.
      I think Rogers is just being a bitch. They’ve had a monopoly over decent phones for so long and yet all of a sudden they went from having the best network to being beat by networks that are 3times as fast.. If Rogers wants to compete without upgrading their netwrok, they to smarten the f*** up and offer people something that makes up for the obviously less impressive network.

        Get your fats straight. Rogers was the first with a 21.6Mbps network (HSPA+). how can Bell claim to be the fastest when it is actually a 3 way tie. As for most reliable, how an they prove that? I could take a poll of 5 people and ask them whom they think is the most reliable. If they say Rogers, would that mean that Rogers could continue with their claims?

      Far be it from me to stand up to Bell, but the advertising is not targetted at CURRENT customers. THEY’RE ALREADY CUSTOMERS. So, are you saying that Bell saying that they HAVE a network that is squeeky clean and fresh and therefore not at capacity and therefore has lots of great bandwidth is somehow a LIE?

      What Rogers is saying is that their OLD network is not their NEW network, so Bell can’t say their NEW network is better than Rogers until EVERY SINGLE CDMA SUBSCRIBER SWITCHES?

      That is hogwash right off the hog.

      … that is to say, Bell’s HSPA network is larger and better than Rogers. All bell has to do is download a few hundred megabytes over the air on a HSPA device and clock the number of seconds. I bet it’s faster than Rogers.

      The second that Bell’s network is NOT faster than Rogers, Bell should stop saying it is faster. I bet Rogers could even purchase a Bell phone and do the tests themselves (likely they already have!) and note that Rogers doesn’t say “we have tested Bell’s network, and the speed doesn’t meet their claims”.

      Rogers wants to say “Wahhhhhh! They have a pool that no one has peed in yet, and they’re saying the water is better… but we don’t want them to say that. They should have to allow people to think their pool is full of pee like ours. Come swim in OUR pee pool!”

    they Screwed WIND and now they have each other to fight over costumers money to see who should get more. i’m pretty sure rogers or bell have been paying someone ransom to stop WIND because obviously they don’t want any competition they want to be themselves alone so they can play with people and raise the prices and change the rules whenever they want and public have no choice but to stay with these criminals, the government does not protects the poor customers, who ever pays they win, they are screwing us over with our money that we as costumers have been paying them for years, we have one of the Longest contracts and most expensive wireless networks in THE WORLD when I talk to my friends in other countries they can not believe when I tell them how much we pay in Canada,

    missing the points. it’s about misrepresentation… when you have 100 people downloading webpages and ringtones versus 10000 – the perceived network speed (and reliability) will be very very different. Rogers has a point.

    I dont see the point. If you have 100 people downloading and your network is still faster then isnt it still faster? Shouldnt the company with 10000 people downloading possibly do some upgrades to keep up?

    So typical. Of course, the Big Three would rather spend money fighting each other than improving their own networks or most importantly, their customer service!

    Still holding out for WIND…I mean, even if they end up merging with “ROBELLUS” to form “ROBINUS” (creds to HoFo, and I don’t think they’d sink that low anyway), since it’s no contract I can always just leave, right?

    before you make outrageous claims about a network I’d be for everyones benifit if you did your homework. Rogers has had the 21mbps HSPA network active in major markets (Toronto, Montreal, Ottowa, Vancouver, etc.) since the end of the summer. sure the bell network might be a little faster right now but come a year from now we’ll see who comes out on top. Fact of the matter is that with the exeption of the Hero, Rogers has all of the desireable data heavy smartphones, bringing it in loads of $$$ letting it upgrade it’s network to be faster and more robust. bell and tellus have spent all of their money building this nationwide network that they can’t afford to keep up the pace.

    Come to the United States. The Ridiculousness goes on between AT&T and Verizon. They have 170 million suscribers between the two of them. We have to hear all their squabbling, deceptive advertising, confusing offers, claims and court cases. How do you like that from these two titans? They have it all and act like two – 2 year olds. They have the power, market share and soon will be making all the telecommunications decisions in the U.S. They act like no other telecommunications company or carrier can offer a service comparable to them or earn revenue – JUST THEM!!!

    It’s shocking how many of you have so little concept of how a business operates.

    One: Bell, Roger’s, and Telus are all now using an HSPA+ 21.6Mbps network – technology NOT designed by the service providers but by companies that design mobile technology.

    Two: I doubt BGR is the only website you frequent about cell phones, if you looked at anything cell phone related you’d realize that MOST PHONES DON’T EVEN GO PAST 3.6Mbps! Any carrier employee that tells you your phone will go at 21Mbps is an idiot.

    Three: Bell’s network is not “better”, it’s just empty.

    Four: Telus had a point in suing Roger’s because they can’t claim “twice as fast” anymore.

    Five: Roger’s has a point in going after Bell for the same reason. You can’t claim it’s the best network when it totes the exact same technology. Bell is capitalizing on the fact that no one is on their network yet.

    Six: to whomever said companies should spend less on marketing and use it to lessen the price of plans. Your poor grammar aside, read a book. Marketing is how they attract and communicate with you.

    Seven: Cell phone service is EXPENSIVE in comparison to other countries. Low population, large geographic coverage, 3 companies = high cost. The more companies, the more competition, the lower the cost. You don’t need to take a business class to understand that (although a couple of you seem like you need to). When 1/6th of the world’s population is in India you’re damn right their cell phone costs will be dirt cheap.

    Eight: Roger’s goes LTE in two months.

    Nine: Companies don’t want to make feelings or friends… they want MONEY. They’re all very aware that the more bullshit that is associated with their company the more unhappy consumers are and the less money they make. Why do you think Bell plans were so high for so long? No one wanted to buy from them.

    Ten: If the 18-25 demographic wasn’t so fucking indecisive and could remain a customer for more than 8months you wouldn’t have such a vast problem of customer acquisition.

    The bottom line is that the reason it’s so expensive in Canada is because it’s expensive to maintain a service when there is no competition, small amount of customers, and a large demographic of customers who maintain very little loyalty. When the new carriers finally launch you’ll see a steady decline in prices. The system access fee was never a “fuck them over tax”. It went towards the cost of providing a service. Due to the amount of people who could not understand that concept, the MARKETING departments realized that people respond better to flat costs. Therefore now you see no SAF anymore.

    That was way longer than I expected it to be but the lack of people who clearly do not investigate the service or how it works that they pay lots of money to each month astonishes me. I bet people who do mortgages laugh at people who bitch about 3year contracts. Don’t want to do 3 year contracts? BUY THE PHONE! Oh, you don’t have the money and you want your service provider to pay for you? Contract your business. Business do contracting all around the globe. Cell phone companies get a bad rep all around the world because people expect top of the line electronics for $50 dollars and the ability to change their mind on it 4 months later.
